9. Improper political c<strong>on</strong>tributi<strong>on</strong>s<br />

One of the most difficult challenges in developing anti-corrupti<strong>on</strong> measures is<br />

to make the distincti<strong>on</strong> between legitimate c<strong>on</strong>tributi<strong>on</strong>s to political<br />

organizati<strong>on</strong>s and payments made in an attempt to unduly influence present<br />

or future activities by a party or its members <strong>on</strong>ce they are in power. A<br />

d<strong>on</strong>ati<strong>on</strong> made because the d<strong>on</strong>or supports the party and wishes to increase<br />

its chances of being elected is not corrupt; it may be an important part of the<br />

political system and, in some countries, is a basic right of expressi<strong>on</strong> or<br />

political activity protected by the c<strong>on</strong>stituti<strong>on</strong>. A d<strong>on</strong>ati<strong>on</strong> made with the<br />

intenti<strong>on</strong> or expectati<strong>on</strong> that the party will, <strong>on</strong>ce in office, favour the interests<br />

of the d<strong>on</strong>or over the interests of the public is tantamount to the payment of a<br />

bribe.<br />

Regulating political c<strong>on</strong>tributi<strong>on</strong>s has proved difficult in practice. D<strong>on</strong>ati<strong>on</strong>s<br />

may take the <str<strong>on</strong>g>for</str<strong>on</strong>g>m of direct cash payments, low-interest loans, the giving of<br />

goods or services or intangible c<strong>on</strong>tributi<strong>on</strong>s that favour the interests of the<br />

political party involved. One comm<strong>on</strong> approach to combating the problem is to<br />

introduce measures that seek to ensure transparency by requiring disclosure<br />

of c<strong>on</strong>tributi<strong>on</strong>s, thus ensuring that both the d<strong>on</strong>or and recipient are politically<br />

accountable. Another is to limit the size of c<strong>on</strong>tributi<strong>on</strong>s to prevent any <strong>on</strong>e<br />

d<strong>on</strong>or from having too much influence.<br />
