Schedule 2 – Amendments to the Model Subordinate Law on the Transport of Dangerous Goods by Road or Rail 2007 1. Document being amended by this Schedule This Schedule amends the Model Subordinate Law on the Transport of Dangerous Goods by Road or Rail 2007. 2. Reference to a load of dangerous goods (1) In clauses 1.1.6(2), 5.3.1(1), 5.3.2(1), 8.1.1(1), 8.1.1(2), 8.1.2(1), 8.1.3(1), 8.1.4(1) and 9.1.1(1)(b), for "load of dangerous goods" substitute "load that contains dangerous goods". (2) In clause 1.2.1, in the definition of placard load, for "load of dangerous goods" substitute "load that contains dangerous goods". 3. Small consignments of packages not requiring marking For clause 1.1.7(2)(a) substitute – "(a) that are not Division 6.2 substances and that are in a consignment where the aggregate quantity of dangerous goods is less than the quantity for which an inner package is required by the ADG Code to be marked with a proper shipping name or the technical name of the substance (ADG Code 5.2.1.8); or". 4. Updating of references to ATC (1) In clause 1.2.1 – (a) omit the definition of Australian Transport Council; (b) after the definition of service equipment insert – "Standing Council on Transport and Infrastructure means the council of Commonwealth, New Zealand, State, Australian Capital Territory and Northern Territory Ministers, established on 11 June 1993 as the Australian Transport Council and subsequently restructured as the Standing Council on Transport and Infrastructure, but constituted so that it consists of only 1 Minister representing each of the Commonwealth, the States, the Australian Capital Territory and the Northern Territory.". (2) In clause 14.2.2(1), for "Australian Transport Council" substitute "Standing Council on Transport and Infrastructure". 5. Cargo transport units (1) In clause 1.2.1 – (a) after the definition of capacity insert – "cargo transport unit means – CONSULTATION DRAFT 6
(b) (c) (a) (b) (c) (d) (e) (f) a road transport tank or freight vehicle; or a railway transport tank or freight wagon; or a portable tank; or a bulk container; or a freight container; or a MEGC."; in the definition of transport, in paragraph (b), before "transport unit" (wherever occurring) insert "cargo"; omit the definition of transport unit. (2) In clauses 1.2.13, 1.6.1(2)(b), 5.2.2(1), 5.3.3(3), 5.3.5(3), 5.3.6(3), 7.1.2, 7.1.3(1), 7.2.2, 8.1.1(2), 8.1.2(2), 8.1.3(2), 8.1.4(2) and 11.2.4(1), before "transport unit" (wherever occurring) insert "cargo". 6. Other changes to definitions In clause 1.2.1 – "ICAO approved means approved in accordance with the ICAO Technical Instructions. ICAO Technical Instructions means the Technical Instructions for the Safe Transport of Dangerous Goods by Air published by the International Civil Aviation Organisation. IMDG Code means the International Maritime Dangerous Goods Code published by the International Maritime Organisation. IMO approved means approved in accordance with the IMDG Code.". 7. Instruction and training After clause 1.3.1(d) insert – "(da) handling fumigated cargo transport units;". 8. Expansion of scope of administrative determinations (1) In clause 1.6.4 – (a) before "A determination" insert "(1)"; and (b) for paragraph (b) substitute – "(b) applies only to the person, or to the person and to other people named in the application.". (2) At the end of clause 1.6.4 insert – CONSULTATION DRAFT 7
