Constitutional Gas Tax<br />

The Constitutional Gas Tax is collected by the Florida<br />

Department of Revenue and is transferred by the State<br />

Board of Administration (SBA) to the counties. This is a<br />

tax of two cents per gallon on gasoline. The distribution<br />

factor is calculated based on a formula contained in Article<br />

XII of the Constitution. The formula calculates the sum of<br />

three (3) weighted ratios. One fourth is the ratio of county<br />

area to state area. One fourth is the ratio of the county<br />

population to state population. And one half is the ratio of<br />

the total Constitutional Gas Tax collected in each county to<br />

the total collected in all counties of the state during the<br />

previous fiscal year.<br />

Distribution is divided into two (2) parts, an 80% portion<br />

and a 20% portion. The SBA is entitled to keep the 80% portion to meet debt service requirements. However,<br />

the SBA does not administer bond issues for <strong>Orange</strong> <strong>County</strong>. <strong>Orange</strong> <strong>County</strong>, therefore, receives both portions<br />

of this tax. Fund 1003/Constitutional Gas Tax Fund receives the 80% portion and Fund 1002/Transportation<br />

Trust Fund receives the 20% portion.<br />

Total Constitutional Gas Tax is budgeted at $10,300,000 for <strong>FY</strong> 2012-13, increasing slightly over the<br />

<strong>FY</strong> 2011-12 level of $10,200,000.<br />

<strong>County</strong> Gas Tax<br />

Revenue Comparison<br />

The <strong>County</strong> Gas Tax is a one-cent per gallon tax on<br />

gasoline. It is distributed to counties by the Florida<br />

Department of Revenue based on the same formula used to<br />

distribute Constitutional Gas Tax. Up through 6<br />

<strong>FY</strong> 2001-02, this revenue was budgeted in the Gas Tax<br />

Revenue 1977 Debt Service Fund (Fund 2312). Beginning<br />

in <strong>FY</strong> 2002-03 the <strong>County</strong> Gas Tax revenue was budgeted 0<br />

in the Transportation Trust Fund due to the completion of<br />

<strong>FY</strong> 2010-11 <strong>FY</strong> 2011-12 <strong>FY</strong> 2012-13<br />

related debt service payments. For <strong>FY</strong> 2012-13, <strong>County</strong><br />

Gas Tax revenue is budgeted at $4,500,000, holding steady<br />

at the <strong>FY</strong> 2011-12 level.<br />

Local Option Gas Tax<br />

Revenue Comparison<br />

A six-cent per gallon gas tax is levied in <strong>Orange</strong> <strong>County</strong><br />

as provided by the Florida legislature. This tax is<br />

distributed according to annual population estimates<br />

presented by the Bureau of Economic and Business 30<br />

Research. Receipts are collected by the Florida 20<br />

Department of Revenue and distributed monthly to the<br />
