The victim Sivakumar was a resident of Tiruvaiyaru and he had worked as a driver in a private
concern. In the month of June, there was a theft and money was found in the car in which the victim was
the driver. With reference to the case, the Inspector of Tiruvaiyaru had gone to the victim’s house with
police team and raided the house. No money was found, but they have arrested the victim. The victim
Sivakumar was taken to Swamimalai Police Station on 9 th August, 2008. The family members were
not allowed to meet him.
On 17 th August, 2008 the police had contacted the victim’s family members over phone and informed
that the victim was hospitalized as he was unable to pass stools. The family members have rushed to
the hospital, but the victim had died that evening. The wife of the victim had told the RDO that her
husband had died of police torture and insisted for video recording of the postmortem. There were
many injury marks from his buttocks to his leg, his nails were smashed and there was pus formation
all over his legs. But no case was filed against the concerned police officials.

Victim Suresh alias Baba Suresh (26) had resided with his family at 5th Street Korukkupettai in
Chennai-21. He worked as an auto driver in a steel work shop and belonged to the Naicker community.
In 2003 Baba Suresh killed a man while quarreling and he was send to jail. Later he came out. After this
incident, if any incident occurred the police connected Baba Suresh’s name with the case. There were
4 cases of attempt to murder filed against him. Frustrated by that the victim, Baba Suresh left his home
and lived in a concealing area.
18 June 2008 there was a quarrel between some persons and the victim who had gone for compromise
was filed under a false case. 2 nd July 2008 Suresh surrendered himself at the Ponneri Court.. On 9 th
July, the family members of the victim were called to the police station. The police had told the victim’s
mother that her son was hospitalized due to ill health and while he was admitted, he had tried to escape
and had jumped into Coovum River. The family members were also detained at the police station for
the whole night and abused by the police. On 11 th July, 2008 the family members have got the news the
news that the victim Babu Suresh was killed by the police in the name of encounter.
