CME assessment <strong>of</strong> agency<br />

10(1) If the chief medical examiner receives an inquiry report about a<br />

deceased child who, at the time <strong>of</strong> death or within the one year period before<br />

the death,<br />

(a) was in the care <strong>of</strong> an agency as defined in The Child and Family<br />

Services Act; or<br />

(b) had a parent or guardian who was in receipt <strong>of</strong> services from an<br />

agency under The Child and Family Services Act;<br />

the chief medical examiner shall assess the quality or standard <strong>of</strong> care and<br />

service provided by the agency by<br />

(c) examining the records <strong>of</strong> the agency respecting the child and the<br />

parent or guardian; and<br />

(d) reviewing the actions taken by the agency in relation to the child and<br />

the parent or guardian.<br />

CME has ME powers under subsection 9(7)<br />

10(2) For purposes <strong>of</strong> an examination or review under subsection (1), the<br />

chief medical examiner may exercise the powers <strong>of</strong> a medical examiner<br />

under subsection 9(7).<br />

CME to report to minister<br />

10(3) Upon completion <strong>of</strong> an examination or a review under subsection (1),<br />

the chief medical examiner shall, in the form and manner prescribed,<br />

immediately submit a written report to the minister charged by the<br />

Lieutenant Governor in Council with administration <strong>of</strong> The Child and<br />

Family Services Act.<br />

Confidentiality <strong>of</strong> CME report<br />

10(4)A report under subsection (3) is confidential and, for this purpose, is<br />

governed by the provisions <strong>of</strong> Part VI <strong>of</strong> The Child and Family Services Act<br />

as if the report formed part <strong>of</strong> a record to which Part VI applied and is not<br />

governed by section 42 <strong>of</strong> this Act.<br />

CME to prepare summary for annual report<br />

10(5)Despite subsection (4) <strong>of</strong> this section and Part VI (confidentiality) <strong>of</strong><br />

The Child and Family Services Act, the chief medical examiner may
