Behavioural change brought about by the ARA code, <strong>and</strong> other voluntary measures, may have<br />

peaked because the proporti<strong>on</strong> of shoppers most likely to change their habits have already d<strong>on</strong>e<br />

so. A nati<strong>on</strong>wide government survey c<strong>on</strong>ducted in April 2006 c<strong>on</strong>firmed this view. It found that<br />

the majority (67 percent) of resp<strong>on</strong>dents had first taken acti<strong>on</strong> over six m<strong>on</strong>ths to two years ago<br />

with <strong>on</strong>ly an additi<strong>on</strong>al 13 percent having taken acti<strong>on</strong> for the first time in the last six m<strong>on</strong>ths. 79<br />

There is also the issue of equity regarding a voluntary approach. The cost of recent initiatives, such<br />

as the ARA code of practice, has not been borne evenly by all retailers. Some retailers have<br />

indicated that they would be likely to support further reducti<strong>on</strong>s in plastic bag use, but there may<br />

be competiti<strong>on</strong> implicati<strong>on</strong>s if these efforts were not evenly borne across the whole industry.<br />

Certainly, through the efforts of major retailers, the code has been very successful in raising<br />

c<strong>on</strong>sumer awareness of the value of switching to reusable bags.<br />

6.4. State <strong>and</strong> territory envir<strong>on</strong>ment protecti<strong>on</strong> regulatory measures<br />

Each state <strong>and</strong> territory government has in place envir<strong>on</strong>ment protecti<strong>on</strong> legislati<strong>on</strong> <strong>and</strong> associated<br />

regulati<strong>on</strong>s. The legislati<strong>on</strong> each provides an overarching framework at the state or territory level,<br />

which, in turn, provides for the preventi<strong>on</strong>, c<strong>on</strong>trol <strong>and</strong> abatement of polluti<strong>on</strong> <strong>and</strong> envir<strong>on</strong>mental<br />

harm; the c<strong>on</strong>servati<strong>on</strong>, preservati<strong>on</strong>, protecti<strong>on</strong>, enhancement <strong>and</strong> management of the<br />

envir<strong>on</strong>ment; <strong>and</strong> matters incidental to or c<strong>on</strong>nected with the foregoing. Nested within these state<br />

frameworks are specific acts <strong>and</strong>/or regulati<strong>on</strong>s pertaining to waste management.<br />

These regulatory measures are designed to enable designated pers<strong>on</strong>nel (authorised officers) to<br />

resp<strong>on</strong>d to a range of offences relating to polluti<strong>on</strong> to l<strong>and</strong>, water <strong>and</strong> air. In relati<strong>on</strong> to plastic<br />

bags, the envir<strong>on</strong>mental protecti<strong>on</strong> measures are likely to c<strong>on</strong>trol the transport of collected<br />

municipal <strong>and</strong> commercial or industrial wastes, their final disposal destinati<strong>on</strong>, in additi<strong>on</strong> to the<br />

collectors <strong>and</strong> transporters themselves. That is, they are designed to address the end result of<br />

littering rather than the supply of packaging like plastic bags at the retailer’s point of sale. Disposal<br />

behaviour such as littering is usually covered by separate legislati<strong>on</strong>.<br />

Victoria has amended its Envir<strong>on</strong>ment Protecti<strong>on</strong> Act 1970 to enable the Victorian Government to<br />

require retailers who choose to supply plastic bags to charge a minimum fee to c<strong>on</strong>sumers<br />

receiving those bags. This legislati<strong>on</strong> is intended to commence in 2009, if plastic bags are not<br />

phased out through voluntary measures by then. 80<br />
