Maritime law
in the UAE
The UAE is set to become a global
shipping industry hub, from supplies,
bunkering, and repair, to ship finance and
maritime law.
The UAE has become a sophisticated
global shipping environment, with half of
the world’s internationally trading fleet of
tankers passing UAE shores once a year
and a number of new companies are
setting up their maritime business
headquartered in Dubai.
According to the maritime industry
statistics, the UAE spends about half a
billion dollars every
year to buy materials
for building, repairing,
and servicing ships, while
Dubai’s ship repair and supply
sector caters to the needs of up to
400 per year. With a surrounding
sophisticated multi-dimensional
maritime service sector, it is natural that
the UAE has taken the opportunity to join
the emerging maritime centres, with
excellent facilities and a world-class
infrastructure.
The UAE is established as a major
strategic hub for container operations and
as a regional centre for ship management
and a wide diversity of maritime
service infrastructure, ship-repair and
ship supply to ship classification and
maritime law.
The UAE Maritime Law is based on
modern international law and maritime
principles set out in International
Conventions.
Maritime disputes in UAE are determined
in conjunction with laws such as Federal
Law No. 26 of 1981 as amended (maritime
Code), Federal Law No. 11 of 1992 (Civil
Procedures Law), Federal Law No. 18 of
1993 (Commercial Transactions Law) and
International
Conventions (e.g.
IMO Convention of
1948, SOLAS Convention of 1974, London
Convention of 1972, Salvage Convention
of 1989 and etc.) where the UAE is a
member-signatory State.
Discussed below are the UAE Maritime
Rules concerning maritime accidents,
collisions, and salvage.
A ship is any installation or object
which operates or is prepared to
operate in maritime navigation
without consideration as to its
power, tonnage or the purpose behind
its sailing.
Maritime Collision takes place when two
ships or other vessels run foul of each
other, or when one runs of the other. In
