*3-308 Eggs<br />
A. Only clean intact, approved shell eggs meeting applicable grade st<strong>and</strong>ards or pasteurized<br />
shell, liquid, frozen or dry eggs, or pasteurized dry egg products shall be used or offered<br />
for sale.<br />
B. The egg carton must be new, clean <strong>and</strong> properly labeled to include the supplier’s name<br />
<strong>and</strong> address, egg grade, size <strong>and</strong> pack date. FDA Safe H<strong>and</strong>ling Instructions on the<br />
carton are required.<br />
C. Eggs can be offered for sale loose or in a basket, but must have an accompanying card or<br />
sign that contains the required labeling information including the wash <strong>and</strong> process date<br />
versus a pack date as indicated on a carton.<br />
D. Pooling of raw shell eggs is allowed only if the eggs are 41°F (5°C) or below when they<br />
are cracked <strong>and</strong> maintained at 41°F (5°C) or below until cooked.<br />
3-309 Ice<br />
*A.<br />
Only ice which has been manufactured from drinking water <strong>and</strong> h<strong>and</strong>led in a sanitary<br />
manner shall be used or offered for sale. Ice offered for sale shall be packaged <strong>and</strong><br />
properly labeled.<br />
B. Ice for human consumption shall be drained.<br />

Ice used as a cooling medium for <strong>food</strong> storage, beverage containers, <strong>food</strong> containers or <strong>food</strong><br />
utensils shall not be used or sold for human consumption.<br />
3-311 Storage or Display of Food in Contact With Water or Ice<br />
A. Packaged <strong>food</strong> may be stored in direct contact with drinking water if the packaging,<br />
wrapping, or container is not subject to entry of water.<br />
B. Except as specified in C <strong>and</strong> D of this section, unpackaged <strong>food</strong> may not be stored in<br />
direct contact with undrained ice.<br />
C. Whole raw fruits <strong>and</strong> whole or cut raw vegetables, such as celery or carrot sticks or cut<br />
potatoes; <strong>and</strong> tofu may be immersed in ice made with drinking water.<br />
D. Raw chicken <strong>and</strong> raw fish that are received immersed in ice made with drinking water in<br />
shipping containers may remain in that condition while in storage awaiting preparation,<br />
display, service, or sale.<br />
*3-312 Juice<br />
A. Pre-packaged juice shall be obtained pasteurized; in a sterile shelf-stable form in a<br />
hermetically sealed container; or otherwise treated under an approved HACCP plan as<br />
specified in 21 CFR section 120.24, (2003) to attain a 5-log reduction of the most<br />
resistant microorganism of public health significance.<br />
