b. Dead insects <strong>and</strong> insect fragments are prevented from falling on or being<br />

impelled onto exposed <strong>food</strong>, clean equipment, utensils, linens, <strong>and</strong><br />

unwrapped single-service <strong>and</strong> single-use articles.<br />

Devices used to trap insects by adherence may not be installed above exposed <strong>food</strong>, clean<br />

equipment, utensils, linens, or unwrapped single-service <strong>and</strong> single-use articles unless the<br />

device is designed to completely contain the trapped insects.<br />

*8-104 Pesticide Application<br />

A. Only pesticides registered for application in a <strong>food</strong> <strong>establishment</strong> are permitted <strong>and</strong> shall<br />

be applied according to label directions.<br />

B. A pesticide shall be applied so that direct or indirect contact with <strong>food</strong>, equipment,<br />

utensils, linens, <strong>and</strong> single-service <strong>and</strong> single-use articles is prevented by protecting those<br />

items as follows:<br />

1. Removing the items;<br />

2. Covering the items with impermeable covers; or<br />

3. Taking other appropriate preventive actions; <strong>and</strong><br />

4. Cleaning <strong>and</strong> sanitizing equipment <strong>and</strong> utensils after the application of a<br />

pesticide.<br />

C. Bait shall be contained in a covered tamper-proof bait station.<br />

D. Only nontoxic tracking powder such as talcum or flour may be used provided it does not<br />

contaminate <strong>food</strong>, equipment, utensils, linens, single-service or single-use articles.<br />

*8-105 Removing Birds, Insects, Rodents, <strong>and</strong> Other Pests<br />

Birds, insects, rodents, <strong>and</strong> other pests shall be removed from control devices <strong>and</strong> the premises at<br />

a frequency that prevents their accumulation, decomposition, or the attraction of pests.<br />

*8-106 Prohibiting of Animals<br />

*A. Except as specified in (B) <strong>and</strong> (C) of this section, live animals may not be allowed on the<br />

premises of a <strong>food</strong> <strong>establishment</strong>.<br />

B. Provided that the contamination of <strong>food</strong>; clean equipment, utensils, <strong>and</strong> linens; <strong>and</strong><br />

unwrapped single-service <strong>and</strong> single-use articles is controlled, live animals are allowed in<br />

the following situations:<br />

1. Edible fish or decorative fish in aquariums, shellfish or crustacea on ice or under<br />

refrigeration, <strong>and</strong> shellfish <strong>and</strong> crustacea in display tank systems;<br />

2. Patrol dogs accompanying police or security officers in offices <strong>and</strong> dining, sales,<br />

<strong>and</strong> storage areas, <strong>and</strong> sentry dogs running loose in outside fenced areas;<br />

3. In areas that are not used for <strong>food</strong> preparation <strong>and</strong> that are usually open for<br />

customers, such as dining <strong>and</strong> sales areas, service animals that are controlled by<br />

the disabled employee or person. This does not apply to incidental <strong>food</strong> contact<br />

surfaces including dining tables, grocery carts <strong>and</strong> baskets;<br />

4. Pets in the common dining areas of institutional care facilities such as nursing<br />

homes, assisted living facilities, group homes, or residential care facilities at<br />

times other than during meals if:<br />
