7.3 Construction Signage: In addition to a permit board placed on the sample board, a Builder may place<br />
one “approved” sign with identifying information on a construction site after it has received written<br />
approval of home construction plans submitted to the ARC in accordance with Article 3.12. No additional<br />
subcontractor or vendor signs are permitted on site, and no signs may be placed on trees. The Architect or<br />
Designer may be recognized on the sign. A Builder sign must be removed within 60 days after issuance of a<br />
Certificate of Occupancy or thirty days after the sale of the home to the first resident, whichever is first.<br />
ARTICLE 8 – NOTIFICATION – FINES FOR VIOLATIONS<br />
8.1 Notification: Whenever a violation of any provision of the <strong>Architectural</strong> <strong>Guidelines</strong> or CC&Rs of<br />
<strong>Summerhouse</strong> occurs, the ARC or the Association Manager will notify Owner / Builder of the<br />
violation by means of personal service, e-mail, US regular mail or certified mail.<br />
The notifications will state the violation and give the Owner/Builder ten (10) days in which to<br />
remedy the violation. In the event the violation is not remedied within the ten (10) day period, the<br />
HOA may levy fines in accordance with the provisions of the North Carolina Planned Community<br />
Act, and, in the case of construction violations, may also reduce the Compliance Security Deposit<br />
refund in accordance with the provisions of Article 3.5.<br />
8.2 Fines for Violations: In accordance with the North Carolina Planned Community Act:<br />
1. the initial fine for the first violation or the first day of any continuing or repetitive violation shall not<br />
be less than $100.00<br />
2. Following an adjudicatory hearing, the association may levy fines up to the maximum level permitted<br />
by law, which may be up to $100.00 per day until the non-compliance is corrected.<br />
ARTICLE 9 – COMMUNITY OBSERVANCES:<br />
9.1 Common Areas<br />
Except with the prior written permission of the ARC, Builders and subcontractors are not allowed<br />
in the Common Areas or allowed to cross any Common Areas that are not paved streets or to park<br />
in Common Areas.<br />
9.2 Speed Limits<br />
The speed limit for Builders, subcontractors and construction vehicles is twenty-five mile per hour<br />
(25 MPH).<br />
9.3 Any contractor utilizing private property for construction layout shall obtain written permission<br />
from that owner which shall be provided to the ARC prior to using that property.<br />
