COLORADO:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOULDER,
Section 1. City Council authorizes the city manager and/or the city manager’s designees
and agents to formally negotiate for the acquisition of the property described in Exhibit A or any
parts thereof, as they may be adjusted to accommodate the project.
Section 2. City Council authorizes the city attorney, and/or his or her designee, to
acquire the property or through-the-fence agreement property interests described herein for the
city by the exercise of the city’s power of eminent domain should negotiations for the acquisition
of the property interests not be successful, and further authorizes the initiation of condemnation
proceedings to acquire the above-designated property or property interests for the city.
Section 3. This ordinance is necessary to protect the public health, safety, and welfare of
the residents of the city, and covers matters of local concern.
Section 4. The council deems it appropriate that this ordinance be published by title only
and orders that copies of this ordinance be made available in the office of the city clerk for public
inspection and acquisition.
