Evidences for <strong>the</strong> Issue
Before going into <strong>the</strong> verdict concerning <strong>the</strong> operations, and mentioning <strong>the</strong> statements of
<strong>the</strong> scholars about <strong>the</strong>m, and resolving some misunderstood issues - it is appropriate for us
to first present some of <strong>the</strong> Shar’ī evidences, and <strong>the</strong>n follow <strong>the</strong>m up with discussion and
application <strong>the</strong>reof. We will not analyze <strong>the</strong> chains of transmission of each narration
separately; we will regard it as sufficient that <strong>the</strong> main foundation of <strong>the</strong> evidences is in Al-
Bukhārī and Muslim, and hence any reports outside of <strong>the</strong>se two books is streng<strong>the</strong>ned by
<strong>the</strong>m.
One:
إِن َّ الل َّه اشترى مِنال ْمؤمِنِين أ َنف ُسهم وأ َموال َهم بِأ َن َّ ل َهم ال ْجنة َ يق َاتِل ُون َ فِي سبِيلِ‏ الل َّهِ‏ ف َيق ْتل ُون َ ويق ْتل ُون َ وعدا ً
عل َيهِ‏ حق ّا ً فِي التوراةِ‏ والإِنجِيلِ‏ وال ْق ُرآنِ‏ ومن أ َوف َى بِعهدِهِ‏ مِن الل َّهِ‏ ف َاستبشِروا بِبيعِك ُم ال َّذِي بايعتم بِهِ‏
وذ َلِك هو ال ْف َوز ال ْعظِيم ﴾
﴿
“Verily, Allāh has purchased from <strong>the</strong> believers, <strong>the</strong>ir lives and <strong>the</strong>ir wealth in return
for Paradise being <strong>the</strong>irs. They fight in <strong>the</strong> Path of Allāh, so <strong>the</strong>y kill (o<strong>the</strong>rs) and are
killed. It is a promise in truth which is binding on Him in <strong>the</strong> Torah and <strong>the</strong> Gospel
and <strong>the</strong> Qur’ān. And who is truer to his covenant than Allāh Then rejoice in <strong>the</strong>
bargain which you have concluded. That is <strong>the</strong> supreme success.” 9
So this verse is <strong>the</strong> foundation of <strong>the</strong> bargain between <strong>the</strong> Mujāhid and his Lord. Hence, any
scenario in which <strong>the</strong> Mujāhid offers <strong>the</strong> price in order to attain <strong>the</strong> merchandise, it is
permissible unless an evidence exists to specifically prohibit it.
Two:
ك َم مِن فِئ َةٍ‏ ق َلِيل َةٍ‏ غ َل َبت فِئ َة ً ك َثِيرة ً بِإِذ ْنِ‏ الل َّهِ‏ والل َّه مع الصابِرِين ﴾
“How often a small force overcame a mighty force, by <strong>the</strong> Permission of Allāh. And
Allāh is with <strong>the</strong> patient ones.” 10
This verse indicates that <strong>the</strong> measure of power and strength in <strong>the</strong> Sharī’ah is not primarily
linked to material, worldly measures.
