395 4. “Day Off” Defined.<br />

A day off for purposes of interrupting consecutive days shall be<br />

defined as a lapsed period of thirty (30) consecutive hours or more<br />

from the time the Employee completed his/her last worked shift to<br />

the start of the next shift worked.<br />

396 C. Not Intent of Section to Avoid Payment of Overtime.<br />

It is not the intent of this section to avoid payment of overtime or premium<br />

payments referred to in this <strong>Agreement</strong> for Employees working more than<br />

eight consecutive hours at any time.<br />

397 D. Alternative Schedules.<br />

The foregoing notwithstanding, nothing in this Section will preclude the<br />

establishment of Alternative Schedules (e.g. 10 hour shifts/12 hour shifts)<br />

at straight time pursuant to those <strong>Agreement</strong>s.<br />

398 E. Overtime Rates.<br />

399 1. Hours Worked in Excess of 8 in a Day or 40 Hours in a Week.<br />

All hours worked in excess of eight (8) in any day, or in excess of<br />

forty (40) in one (1) week, shall be paid at the overtime rate of one<br />

and one-half (1 1/2) times the straight time hourly rate.<br />

400 2. Commencing Work Earlier than in the Preceding Day.<br />

In the event an Employee’s work schedule causes him/her to<br />

commence work earlier than in the preceding day, the overtime rate<br />

set forth above shall be paid for work in excess of eight (8) hours in<br />

the preceding work day only if the Employee commences his/her<br />

workday two (2) hours or more earlier than his/her preceding<br />

workday, but not if the earlier scheduling is made at the Employee’s<br />

request.<br />

401 3. Hours Worked in Excess of 12.<br />

All hours worked in excess of twelve (12) hours in one (1) day shall<br />

be paid at the rate of two (2) times the straight time hourly rate.<br />

402 4. Hours Worked in Excess of 16.<br />

All hours worked in excess of sixteen (16) in one (1) day shall be<br />

paid at the rate of two and one-half (2 1/2) times the straight time<br />

hourly rate.<br />
