ARTICLE 7. DISABILITY<br />

Section 1.<br />

Indemnity Provisions<br />

A. An employee covered by Florida Statute, Chapter 440,<br />

Workers’ Compensation, and in accordance with provisions<br />

set forth hereunder, shall be authorized to be absent from<br />

work due to injury or illness incurred while on duty, and<br />

directly related to work performed, until he or she reaches<br />

maximum medical improvement or two (2) years, whichever<br />

comes first.<br />

B. A regular status or probationary employee injured while:<br />

1. Responding to a dispatched call for service;<br />

2. Engaging in performing services at a dispatched<br />

call;<br />

3. Providing emergency services while on-duty or off-duty<br />

in connection with their employment with the City;<br />

4. Engaging in Fire Department sponsored training;<br />

5. Engaging in physical training on-duty;<br />

6. Operating a departmental vehicle and/or equipment;<br />

and/or<br />

7. Performing any on-duty assignments;will receive duty<br />

disability pay in an amount that, when added to<br />

payments made for lost wages under F.S. 440, Workers’<br />

Compensation, will equal 100% of his or her base<br />

salary. These duty disability payments will be paid<br />

for up to one hundred eighty (180) days only if the<br />

employee is unable to perform in a light duty<br />

assignment and where the employee has applied for and<br />

has been found eligible to receive payment for lost<br />

wages under workers’ compensation. Any injury<br />

occurring in the field shall be presumed to be a duty<br />

disability unless proven otherwise.<br />

C. Up to an additional one hundred eighty (180) calendar days<br />

of Duty Disability Leave may be granted in the case of<br />

surgical intervention or hospitalization so long as medical<br />

certification clearly demonstrates such is required and so<br />

long as the authorized medical practitioner(s) certifies<br />

that the employee is unable to perform in a light duty<br />

assignment.<br />
