2. The employee provides proof of qualified credible<br />

coverage to the Benefit Fund and the City.<br />

3. The City shall not be required to make any<br />

contribution to the Benefit Fund for the employee<br />

“opting out”. Instead the City shall only be required<br />

to offer the “opting out” employee City-sponsored<br />

dental and vision coverage and provide City-sponsored<br />

life (including accidental death and disability and at<br />

the same coverage limits as those given to the Benefit<br />

Fund members) coverage.<br />

D. The City shall begin monthly contributions to the Benefit<br />

Fund on the first day of the first month after hiring a new<br />

employee. If an employee begins work on the first day of<br />

the month, contributions shall begin that month.<br />

Section 4.<br />

Legal Services Plan<br />

A. The City agrees to create a post-tax deduction from<br />

employees who authorize deductions for the Benefit Fund’s<br />

current legal plan provider on the following conditions:<br />

1. That the Union agrees to participate with all other<br />

union groups and unrepresented employees in selecting<br />

a City-wide legal plan provider and the following<br />

seven (7) persons shall constitute the selection<br />

committee for a legal provider: One employee<br />

representing and selected by each bargaining unit<br />

except that the two bargaining units representing<br />

sworn police offers shall be represented by only one<br />

employee; one employee representing and selected by<br />

the non-union represented employees; one employee<br />

representing the human resources department and<br />

selected by the human resources director; and one<br />

employee representing management and selected by the<br />

Mayor.<br />

2. That the Benefit Fund’s current legal plan provider<br />

will not be used to assist employees with legal<br />

actions directly or indirectly involving the City<br />

including but not limited to employment discrimination<br />

claims, grievances and workers compensation claims.<br />
