C. The arbitrator will be required to rule whether or not the<br />

City ordered the alcohol or substance abuse screen in<br />

compliance with Article 10, of this agreement. Test results<br />

will not be released to the City unless the arbitrator<br />

confirms that the City ordered the testing based on<br />

reasonable suspicion as defined in Article 10.<br />

D. The arbitrator will make a bench ruling at the close of the<br />

hearing and an oral response will be sufficient to settle<br />

the grievance. Such oral response shall be reduced to<br />

writing for the record by the arbitrator and submitted to<br />

the parties within five (5) business days from the close of<br />

the hearing.<br />

Section 4. Selection of the Expedited Arbitrator and Scheduling<br />

of the Expedited Hearing<br />

A. The City and the Union shall follow the established list of<br />

Arbitrators currently on file with both the IAFF and the<br />

City for expedited arbitrations only.<br />

B. The hearing shall be scheduled at a mutually agreed upon<br />

time by both parties and based on the availability of the<br />

Arbitrator. A list of available arbitration dates will be<br />

requested from the arbitrator. Upon receipt, the parties<br />

will alternately strike dates until one date remains. A<br />

coin toss will determine who will strike first. If an<br />

arbitrator has no dates available, the next arbitrator on<br />

the list will be called.<br />

Section 5. Arbitration Selection for other than Expedited<br />

Arbitration Hearings<br />

A. An arbitration that does not fall under expedited<br />

arbitration shall require a new arbitrator selection.<br />

B. The panel shall consist of seven (7) qualified neutrals<br />

requested from the Federal Mediation and Conciliation<br />

Services (FMCS) by the party requesting arbitration. Within<br />

five (5) working days after the receipt of the list, the<br />

parties shall meet and alternately cross out the names on<br />

the list, and the remaining name shall be the arbitrator. A<br />

coin shall be tossed to determine who shall cross out<br />

first. The arbitration shall be withdrawn if after 90 days<br />

subsequent to the selection of an arbitrator, the grieving<br />

party fails to take any action.<br />
