C. The date of the hearing shall be scheduled no later than<br />

thirty (30) days from the date the arbitrator is<br />

selected. A list of available arbitration dates will be<br />

requested from the arbitrator. Upon receipt, the parties<br />

will alternately strike dates until one date remains. A<br />

coin toss will determine who will strike first. If an<br />

arbitrator has no dates available within the next sixty<br />

(60) days, the last arbitrator struck will be called.<br />

Section 6.<br />

Hearing Procedures<br />

A. The hearing on the grievance shall be informal and the<br />

strict rules of evidence shall not apply.<br />

1. The hearing shall be conducted by the arbitrator in<br />

whatever manner will most expeditiously permit a<br />

full presentation of the evidence and arguments of<br />

the parties.<br />

2. The arbitration may proceed in the absence of any<br />

party who, after due notice, fails to be present. An<br />

award shall not be made solely on the default of a<br />

party. The arbitrator shall require the attending<br />

party to submit supporting evidence.<br />

B. The arbitrator shall make an appropriate record of the<br />

proceedings. Either party to this agreement may tape<br />

record the proceedings in lieu of creating a stenographic<br />

record.<br />

C. Either party to this agreement desiring transcripts of<br />

the arbitration hearings shall be responsible for the<br />

cost of such transcripts. The use of transcripts shall<br />

not cause the extension of time frames for the<br />

arbitrator's decision unless a time extension is mutually<br />

agreed upon by the parties.<br />

D. Normally, the hearing shall be completed in one (1) day.<br />

In unusual circumstances and for good cause shown, the<br />

arbitrator may extend the hearing beyond one (1) day, and<br />

schedule an additional hearing, within five (5) working<br />

days.<br />

E. When both sides have completed their presentations, the<br />

arbitrator shall ask whether either party has any further<br />

evidence to offer or witnesses to be heard. Upon<br />

receiving negative replies, the arbitrator shall declare<br />

and note the hearing closed.<br />
