6.4.1 Reuse <strong>and</strong> record integrity<br />

Where the public accesses government informati<strong>on</strong> <strong>and</strong> records for potential reuse, original<br />

records should be stored <strong>and</strong> secured in systems that are designed to maintain the authenticity<br />

<strong>and</strong> integrity <strong>of</strong> those records. The c<strong>on</strong>cept <strong>of</strong> the original, authentic <strong>and</strong> reliable record should<br />

remain a fundamental principle. In the interest <strong>of</strong> accountability <strong>and</strong> transparency, government<br />

has an obligati<strong>on</strong> to ensure that this principle is upheld at creati<strong>on</strong> <strong>and</strong> maintained as the record is<br />

managed over time.<br />

Reuse itself may generate new records that will need to be managed as records in their own right.<br />

For example, a government agency may decide to expose a draft policy <strong>on</strong> its website for citizen<br />

c<strong>on</strong>sultati<strong>on</strong>: citizen comments or annotati<strong>on</strong>s will provide input into the final policy, therefore the<br />

annotati<strong>on</strong>s or comments need to be captured as public records.<br />

6.4.2 Use <strong>of</strong> third party sites<br />

The use <strong>of</strong> social web services <strong>and</strong> storage provided by third party providers, such as Flickr, YouTube<br />

<strong>and</strong> Facebook <strong>and</strong> the advent <strong>of</strong> cloud computing present a number <strong>of</strong> potential problems. 273<br />

In some circumstances the physical locati<strong>on</strong> <strong>of</strong> the storage site may affect how <strong>and</strong> whether<br />

Australian laws apply. This is a particular c<strong>on</strong>cern in the case <strong>of</strong> pers<strong>on</strong>al data if the implicati<strong>on</strong> is<br />

that protecti<strong>on</strong>s set out in Australian privacy legislati<strong>on</strong> do not apply or are more difficult to enforce.<br />

Compliance <strong>with</strong> requirements to c<strong>on</strong>duct authorised destructi<strong>on</strong> <strong>of</strong> records may be complicated by<br />

the technical difficulty <strong>of</strong> ensuring that all copies in all locati<strong>on</strong>s are destroyed as required.<br />

There are also issues <strong>of</strong> particular c<strong>on</strong>cern in the Comm<strong>on</strong>wealth c<strong>on</strong>text. The use <strong>of</strong> third party<br />

sites may present problems in exporting data to comply <strong>with</strong> records management requirements.<br />

More importantly, however, is that <strong>of</strong> uncertainty over informati<strong>on</strong> ownership <strong>and</strong> retenti<strong>on</strong> over<br />

time. Under the property-based definiti<strong>on</strong> <strong>of</strong> Comm<strong>on</strong>wealth Record in the Archives Act 1983, 274<br />

any informati<strong>on</strong> created, managed <strong>and</strong> stored <strong>on</strong> third party sites in ’the cloud‘ may not be legally<br />

regarded as Comm<strong>on</strong>wealth property nor, as such, as a Comm<strong>on</strong>wealth record.<br />

In other words the Comm<strong>on</strong>wealth is likely to have no c<strong>on</strong>trol over, nor ownership <strong>of</strong> these<br />

records. They may be destroyed <strong>with</strong>out warning <strong>and</strong> <strong>with</strong>out the Comm<strong>on</strong>wealth having any<br />

recourse. If these records are not legally regarded as Comm<strong>on</strong>wealth records, the public may have<br />

no right <strong>of</strong> access to the records under freedom <strong>of</strong> informati<strong>on</strong> or archives legislati<strong>on</strong>.<br />

6.4.3 Preservati<strong>on</strong> <strong>of</strong> digital formats<br />

PSI created in any format, including digital formats, <strong>of</strong>ten needs to be preserved for periods <strong>of</strong> time<br />

that extend bey<strong>on</strong>d the life <strong>of</strong> the system <strong>of</strong> the s<strong>of</strong>tware applicati<strong>on</strong> in which they were created<br />

or disseminated. To ensure the <strong>on</strong>going useability <strong>of</strong> PSI it is important for agencies to use open<br />

file formats that comply <strong>with</strong> openly documented <strong>and</strong> interoperable st<strong>and</strong>ards. Failure in this area<br />

creates the risk that the informati<strong>on</strong> may become unreadable as a result <strong>of</strong> technological change.<br />

The use <strong>of</strong> open file formats allows others to build tools capable <strong>of</strong> presenting or repurposing the<br />

informati<strong>on</strong> for as l<strong>on</strong>g as that informati<strong>on</strong> has value.<br />
