2. <strong>Wicklow</strong> County Council is committed <strong>to</strong> meetings its obligati<strong>on</strong>s under <strong>the</strong> Water<br />

Framework Directive and it is not c<strong>on</strong>sidered that any of <strong>the</strong> provisi<strong>on</strong> of <strong>the</strong> plan<br />

would compromise realisati<strong>on</strong> of <strong>the</strong>se objectives.<br />

3. There are a number of locati<strong>on</strong>s in <strong>Kilcoole</strong> where existing development is already<br />

in close proximity <strong>to</strong> surface waters. In such situati<strong>on</strong>s, it is not possible <strong>to</strong> implement<br />

new set backs. However, where surface water traverse new development areas, <strong>the</strong><br />

Council will require c<strong>on</strong>sultati<strong>on</strong> with <strong>the</strong> envir<strong>on</strong>mental authorit<strong>ie</strong>s and <strong>the</strong><br />

implementati<strong>on</strong> of protective measures and it is recommended that this be included as<br />

a requirement in <strong>the</strong> plan (also see recommendati<strong>on</strong>s under Submissi<strong>on</strong> No. 3 above<br />

with regard <strong>to</strong> AA3 )<br />

4. Chapters 9 and 10 of <strong>the</strong> County Development Plan 2004 set out <strong>the</strong> Council’s<br />

polic<strong>ie</strong>s with regard <strong>to</strong> flood plains i.e.<br />

Policy W7: Within <strong>the</strong> var<strong>ie</strong>ty of watercourses that <strong>the</strong> Council c<strong>on</strong>siders may be<br />

susceptible <strong>to</strong> flooding, developers may be required <strong>to</strong> provide hydraulic and flood<br />

impact informati<strong>on</strong> in support of <strong>the</strong>ir planning applicati<strong>on</strong>. In such cases, developers<br />

must show <strong>the</strong> measures <strong>the</strong>y will take <strong>to</strong> minimise flood risk, including attenuati<strong>on</strong> in<br />

situ and downstream of <strong>the</strong>ir development <strong>to</strong> <strong>the</strong> satisfacti<strong>on</strong> of <strong>the</strong> Council.<br />

Policy HL 14: The Council will discourage proposals for development that are in, or<br />

would interfere with <strong>the</strong> natural flood plain.<br />

These polic<strong>ie</strong>s will be implemented in <strong>Kilcoole</strong> and will afford <strong>the</strong> required protecti<strong>on</strong><br />

<strong>to</strong> flood risk z<strong>on</strong>es.<br />

6. It is <strong>the</strong> stated policy of <strong>the</strong> draft plan that ‘No new development shall be permitted<br />

unless <strong>the</strong>re is adequate capacity in <strong>the</strong> wastewater collecti<strong>on</strong> and treatment systems’<br />

(Part B, Secti<strong>on</strong> 9)<br />

<str<strong>on</strong>g>Managers</str<strong>on</strong>g> Recommendati<strong>on</strong><br />

Make <strong>the</strong> following amendment <strong>to</strong> <strong>the</strong> LAP:-<br />

Add new objective under Part B, Secti<strong>on</strong> 10 as follows:-<br />

• Where new development is adjoining surface waters, a minimum buffer z<strong>on</strong>e<br />

of 10m shall be maintained between <strong>the</strong> riverbank and new development. The<br />

developer shall c<strong>on</strong>sult with <strong>the</strong> DoEHLG and <strong>the</strong> ERFB <strong>to</strong> determine <strong>the</strong><br />

most appropriate layout, design and usage of <strong>the</strong> buffer z<strong>on</strong>e<br />
