An adult performance establishment shall not bedeemed a place provided or set apart for the purpose <strong>of</strong> exposing or exhibiting a person's sexual organsin a manner contrary to the first sentence <strong>of</strong> F.S. § 800.03, the state's indecent exposure statute, as setforth in the decision <strong>of</strong> the Supreme Court <strong>of</strong> <strong>Florida</strong> in the case <strong>of</strong> H<strong>of</strong>fman v. Carson, 250 So. 2d891, 893 (Fla. 1971), appeal dismissed 4<strong>04</strong> U.S. 981 (1971).Adult theater: any establishment that has adult booths where adult material may be viewed or anyestablishment that has an auditorium, rooms, or an open-air area where persons may view films, motionpictures, videocassettes, slides or other photographic reproductions that have as their primary or dominanttheme matters depicting, illustrating or relating to specified sexual activities or specified anatomical areas.Adult motels and adult booth or peep show arcades are considered to be adult theaters.Adverse impact (roads): where project traffic added to background traffic or <strong>of</strong>ficial benchmark trafficcount increases the traffic volume on an impacted thoroughfare road beyond the maximum allowablevolume established for the minimum acceptable level <strong>of</strong> service standard as adopted in the <strong>City</strong>'sComprehensive Plan.Advertising: any form <strong>of</strong> public announcement intended to aid, directly or indirectly, in the sale, use, orpromotion <strong>of</strong> a product, commodity, service, activity, or entertainment.Agricultural use: the use <strong>of</strong> land in horticulture, floriculture, viticulture, forestry, dairy, livestock,poultry, bee-keeping, pisciculture and all forms <strong>of</strong> farm products and farm production. This definitionalso includes "normal farming operation".Agricultural waste: solid wastes resulting from the rearing and slaughtering <strong>of</strong> animals and theprocessing <strong>of</strong> animal products, orchard and field crops which are stored, transported or disposed <strong>of</strong> as anunwanted waste material.Air curtain incinerator: a portable or stationary combustion device that directs a plane <strong>of</strong> high-velocityforced draft air through a manifold head into a pit with vertical walls in such a manner as to maintain acurtain <strong>of</strong> air over the surface <strong>of</strong> the pit and a re-circulating motion <strong>of</strong> air under the curtain.Alcoholic beverage: drink containing more than one percent <strong>of</strong> alcohol by weight.Alley: a roadway dedicated to public use which affords only a secondary means <strong>of</strong> access to abuttingproperty and not intended for general traffic circulation.Alteration: any changes in structural parts; type <strong>of</strong> construction; kind or class <strong>of</strong> occupancy. The word"alteration" shall include the word "alter" or "reconstruct."Altered wetlands: wetlands which have been substantially affected by man, but which continue to bedominated by wetland or transitional vegetation.Animals: includes, but is not limited to, both household pets and farm animals. A living organism otherthan a plant or bacterium, including fish, amphibians, reptiles, birds, and mammals. For purposes <strong>of</strong> thisordinance the term animal excludes humans.Animal shelter: a lot and/or building or part there<strong>of</strong> used for the care <strong>of</strong> lost, abandoned, or neglectedanimals.Animated sign: any sign that utilizes motion <strong>of</strong> its parts by any means, or displays flashing, oscillating, orintermittent lights. This term also includes the use <strong>of</strong> animals or people for advertising purposes. Thisdefinition includes signs with rotating panels, generally referred to as trivision signs. Antenna: an arrangement <strong>of</strong> wires or metal rods used in transmitting or receiving electromagneticwaves.Apartment: a rental dwelling unit that is located within the same building with at least two otherdwelling units. Sites included in this land use are triplexes and all types <strong>of</strong> apartment buildings. Theapartments in this land use include both low-rise or "walk-up" dwellings and high-rise.Apartment, garage: an accessory building containing a storage area for one or more motor vehicles andone single-family dwelling occupying not more than 800 square feet <strong>of</strong> living area.Apartment house: See multiple-family dwelling.Appeal: a request for a review <strong>of</strong> the enforcement <strong>of</strong>ficial's interpretation <strong>of</strong> any provision <strong>of</strong> thisordinance or a request for a variance.Applicant: any person applying for or who has been granted a development order and/or permit toproceed with a project.Area <strong>of</strong> copy: the entire area <strong>of</strong> the advertising display surface area encompassed within any sign.Area <strong>of</strong> shallow flooding: a designated AO or AH Zone on the community's Flood Insurance Rate Map(FIRM) with base flood depths from one to three feet where a clearly defined channel does not exist,where the path <strong>of</strong> flooding is unpredictable and indeterminate, and where velocity flow may be evident.Such flooding is characterized by ponding or sheet flow.Area <strong>of</strong> sign: section within a perimeter that forms the outside shape including any frame that forms anintegral part <strong>of</strong> the display, but excluding the necessary supports or uprights on which the sign may beplaced. If the sign consists <strong>of</strong> more than one section or module, all areas will be totaled. On any sign withmore than one face, only the square footage <strong>of</strong> the face visible from any one direction at a time will becounted, provided that all faces are equal in size and contained in a common perimeter. When a sign iscomposed <strong>of</strong> letters only, the sign area is the sum <strong>of</strong> the areas <strong>of</strong> the rectangles enclosing all letters.
