Also see "construction, start <strong>of</strong>."Escort: any person who, for commercial or pecuniary gain, compensation or tips, agrees to, <strong>of</strong>fers to go,or goes to any place, including a business, hotel, motel, residence or conveyance to do any <strong>of</strong> thefollowing acts:(1) Act as a companion or date for or converse with a customer;(2) Engage in physical contact with another person;(3) Provide private adult entertainment;(4) Engage in private modeling or lingerie modeling;(5) Display specified anatomical areas, strip naked, or go topless; or(6) Engage in any specified sexual activity.Nothing in this definition shall be construed to legalize prostitution or other conduct prohibited by thischapter or other law.Escort service or escort agency: person, establishment, place or business, operated for commercial orpecuniary gain that does either <strong>of</strong> the following:(1) Advertises as an escort service or escort agency or otherwise <strong>of</strong>fers or advertises that it canfurnish escorts, private dancers or private models; or(2) Offers or actually provides, arranges, dispatches or refers workers, employees, agents orindependent contractors to act as an escort for a patron or customer.It is an affirmative defense that a business is not an escort service if a person seeking to invoke thisdefense can demonstrate that the business is a bona fide dating or matching service that arranges socialmatches or dates for two persons who each wish to meet a compatible companion when neither personsolicits, accepts or receives any financial gain or any monetary tip, consideration or compensation for themeeting or date.Establishment: any place, site or premises, or portion, upon which any person conducts activities oroperations for commercial or pecuniary gain, including any place, site or premises from where an escortservice dispatches or refers workers to other locations, or at which an escort service receives businesscalls from customers.Excavation: the hollowing out, removal by digging or leveling <strong>of</strong> any land, dirt, sand, clay, soil, rock,solid minerals or other soil materials.Excavator: any person who sells or <strong>of</strong>fers for sale, whether directly or indirectly, any excavatedmaterials, or any person who excavates any material and transfers such excavated material from oneparcel <strong>of</strong> land to any noncontiguous parcel.<strong>Ordinance</strong> No. <strong>04</strong>-<strong>2012</strong> <strong>Adopted</strong> June 4, <strong>2012</strong> Page 22 LDC Section 70-30
Existing: the average condition immediately before a legal act <strong>of</strong> development or redevelopmentcommences.Existing Construction: means, for the purposes <strong>of</strong> floodplain management, structures for which the start<strong>of</strong> construction commenced before April 18, 1974. This term may also be referred to as “existingstructures”.Existing manufactured home park or subdivision: a manufactured home park or subdivision for whichthe construction <strong>of</strong> facilities for servicing the lots in which the manufactured homes are to be affixed(including at a minimum the installation <strong>of</strong> utilities, the construction <strong>of</strong> streets, and either final sitegrading or the pouring <strong>of</strong> concrete pads) was completed before April 18, 1974.Expanded residential building site: two or more contiguous lots that front on the same street, that areunder the same ownership, and one <strong>of</strong> which is occupied by a single-family or two-family standarddwelling, and the other <strong>of</strong> which is vacant. A family mayinclude up to six unrelated persons.Farm worker: any person who assists with the chores, operation, security or maintenance <strong>of</strong> a farm orranch.Farm worker living facility: one or more dwellings located on a lot used to house farm workers. Alsoincludes a bunkhouse.Fascia sign.
