Parasite sign: Any sign not exempted by this sign code, for which no permit has been issued, and whichis attached to another sign. These signs are considered non-conforming signs and are subject to removalby the <strong>City</strong>.Parcel <strong>of</strong> land: any quantity <strong>of</strong> land capable <strong>of</strong> being described with such definiteness that its locationand boundaries may be established, which is designated by its owner or developer as a unit or which hasbeen used or developed as a unit.Park: tract <strong>of</strong> land kept for ornament or recreation and maintained as public property.Park impact fee: mean the fee required to be paid in accordance with Chapter 94, article III, Code <strong>of</strong><strong>Ordinance</strong>s.Parking aisle: area immediately adjacent to the car parking stalls which permits maneuvering <strong>of</strong> the carsentering and leaving a parking stall, and which connects the parking stalls to the driveway.Parking stall: the space that is necessary to park a car, excluding aisles and driveways.Partial circulation parking lot: parking lot design which permits a car entering a parking lot to maneuverin front <strong>of</strong> all parking stalls without using the public right-<strong>of</strong>-way.Penthouse: an enclosed structure or structures above the ro<strong>of</strong> <strong>of</strong> a building occupying not more than anaggregate area <strong>of</strong> one-third <strong>of</strong> the area <strong>of</strong> the supporting ro<strong>of</strong>. Penthouses shall not be used for purposesother than the shelter <strong>of</strong> mechanical equipment or shelter <strong>of</strong> vertical shaft openings in the ro<strong>of</strong>.Percent <strong>of</strong> new trips: the number <strong>of</strong> new trips generated by the land development activity.Permanent sign: any sign installed and affixed on-site.Person: an individual, tenant, lessee, owner, firm, association, organization, whether social, fraternal orbusiness, partnership, joint venture, trust, company, corporation, receiver, syndicate, business trust, orother group or combination acting as a unit.Person aggrieved: a resident <strong>of</strong> the <strong>City</strong> <strong>of</strong> <strong>Deltona</strong> or an applicant for an administrative or quasi-judicialaction pursuant to this chapter whose legal right is invaded by a decision complained <strong>of</strong>, or whosepecuniary interest is directly affected by a decision. The person's interest must be specific and personal,not common to all members <strong>of</strong> the community. When the decision affects any public recreation area,however, the phrase shall include any user <strong>of</strong> that area.Person, interested: any person who presents evidence, testimony or argument at any public hearings,whether oral or written, in person or by representative and who provides his or her name and address tothe hearing body.Personal gain sign: sign advertising for personal gain on residential property; for example, a garage, yardor patio sale sign.Pervious area: area maintained in its natural condition, or covered by a material that permits infiltrationor percolation <strong>of</strong> water into the ground.Physical contact: manipulate, wash, scrub, stroke or touch, for commercial or pecuniary gain, anotherperson's body, directly or indirectly, through a medium, using any object, instrument, substance or device.It is an affirmative defense to an alleged violation <strong>of</strong> this chapter regarding engaging in physical contact ifthe alleged violator can establish membership in one <strong>of</strong> the following classes <strong>of</strong> persons or businesses andthe activity alleged to be physical contact is part <strong>of</strong> the bona fide practice <strong>of</strong> the pr<strong>of</strong>ession or business <strong>of</strong>the person, which overlaps into the field regulated by this chapter:(1) A person licensed as a massage therapist or apprentice massage therapist pursuant to F.S. Ch. 480if providing massage services only in a massage establishment licensed under F.S.
