Use of Non-Recommended<br />

Settings<br />

SKIERS REQUESTING SETTINGS NOT<br />

RECOMMENDED BY HEAD/TYROLIA<br />

The <strong>2010</strong>.1 1 HEAD/TYROLIA Release/Retention Adjustment<br />

Table is the only adjustment chart recommended<br />

for use by HEAD/TYROLIA dealers during the <strong>2010</strong>.11<br />

season.<br />

Some skiers may request settings different from those<br />

in the HEAD/TYROLIA Release/Retention Adjustment<br />

Table. Most of these concerns can be addressed by<br />

following the procedures for reclassifying skier type and<br />

for troubleshooting which follow the instructions for<br />

using the HEAD/TYROLIA Release/Retention Adjustment<br />

Table.<br />

HEAD/TYROLIA and the ISO/ASTM standards organizations<br />

do not recommend the use of release/retention<br />

settings outside of these tolerances, but skiers occasionally<br />

may request such settings. HEAD/TYROLIA recognizes<br />

a skier’s right to choose other settings, but if the<br />

skier requests settings outside of those derived from<br />

the normal procedures for reclassifying skier type and<br />

for trouble-shooting, the shop may either:<br />

1. Adjust the system to the setting derived from HEAD/<br />

TYROLIA Release/Retention Adjustment Table and<br />

instruct the skier on how to change the setting (if<br />

this done, make a note to this effect on the workshop<br />

or rental form), or<br />

2. Adjust the system to the skier’s individual request,<br />

but only if the technician notes on the workshop or<br />

rental form the reason the higher or lower setting<br />

was requested. Do not in any case adjust the system<br />

to a release/retention value higher than the maximum<br />

acceptable setting at the bottom of the HEAD/<br />

TYROLIA Release/Retention Adjustment Table. The<br />

customer must verify the request for the higher or<br />

lower settings by signing and dating the workshop or<br />

rental form by the reason noted next to the setting<br />

request. The skier must also read and sign a warning,<br />

release and indemnity agreement identical to the<br />

one printed on this page. In such cases, the system<br />

will only be indemnified if all other conditions of<br />

indemnification are met and the signed warning,<br />

release and indemnity agreement are attached to<br />

the completed work-shop or rental form.<br />

Warning, Release and Indemnity Agreement<br />

hereby acknowledge that I have been advised by the<br />

_________________________________________ rental shop, sales<br />

department, etc.) that settings which I have requested for my<br />

bindings (Model _____________________) is not the setting recommended<br />

by the manufacturer of the bindings for a skier<br />

of my height, weight, age and skier type. I understand and<br />

acknowledge that there may be an increased risk of injury or<br />

death to me as a result of my own personal preference for<br />

these binding settings.<br />

To the fullest extent allowed by law, I hereby waive and<br />

release all claims arising from the use of the bindings and<br />

release from all liability the shop, the distributor and the<br />

manufacturer, their agents and employees, and I further<br />

agree to indemnify them from any and all liability or harm<br />

or damage of any kind whatsoever which may result from<br />

the use of these bindings by myself or anyone I allow to<br />

use the bindings.<br />

I, the undersigned, have read and understand this liability<br />

release agreement, and agree that it is binding upon me,<br />

my heirs, guardians, administrators, assigns, and legal<br />

representatives. If any part of this agreement is held to be<br />

invalid or unenforceable, the remainder shall be given full<br />

force and effect.<br />
