15.2) Any ef<strong>for</strong>t by the bidder to modify his bid or <strong>in</strong>fluence BSNL <strong>in</strong> BSNL’s bid<br />
evaluation, bid comparison or the contract award decision shall result <strong>in</strong> the<br />
rejection of the bid.<br />
16. AWARD OF CONTRACT:<br />
BSNL shall consider award of contract only to those eligible bidders whose<br />
offers have been found technically, commercially and f<strong>in</strong>ancially acceptable.<br />
17. BSNL’S RIGHT TO VARY QUANTUM OF WORK:<br />
BSNL, dur<strong>in</strong>g the period of the contract, reserves the right to decrease or<br />
<strong>in</strong>crease the work by up to 25% of the total value of estimated work<br />
specified <strong>in</strong> the schedule of requirements without any change <strong>in</strong> the rates or<br />
other terms and conditions.<br />
18. BSNL reserves the right to accept or reject any bid and to annul the bidd<strong>in</strong>g process<br />
and reject all bids, at any time prior to award of contract without assign<strong>in</strong>g any reason<br />
what-so-ever and without thereby <strong>in</strong>curr<strong>in</strong>g any liability to the affected bidder or<br />
bidders on the grounds <strong>for</strong> the BSNL’s action.<br />
19. LETTER OF INTENT:<br />
19.1) The Letter of <strong>in</strong>tent (LOI) shall be issued to the accepted bidder with the<br />
<strong>in</strong>tention of BSNL to enter <strong>in</strong>to the contract with the bidder.<br />
19.2) The bidder shall with<strong>in</strong> 10 days of issue of Letter of <strong>in</strong>tent (LOI), give his<br />
acceptance along with Security Deposit.<br />
20. Security Deposit<br />
Amount of Security Deposit will be 10% of the Estimated Cost or accepted<br />
tender cost whichever is higher and will be compulsory. As soon as the<br />
tender is approved by the competent authority, the Bid Security (2.5% of<br />
Estimated Cost of <strong>Tender</strong>) deposited by the successful bidder shall be<br />
compulsorily converted <strong>in</strong>to the Security deposit, which will be held by the<br />
BSNL till the completion of work. Additional S.D. of 2.5% of estimated cost<br />
or accepted tender cost whichever is higher will be deposited <strong>in</strong> the <strong>for</strong>m of<br />
Crossed Demand Draft drawn <strong>in</strong> favour of Accounts Officer (Cash),BSNL<br />
O/o DGMM Kanpur, issued by a scheduled bank or may be deducted from<br />
runn<strong>in</strong>g bills at discretion of BSNL. Rema<strong>in</strong><strong>in</strong>g 5% will be deducted from<br />
the runn<strong>in</strong>g/ f<strong>in</strong>al bills so that the total security deposit will be equal to 10%<br />
(ten percent) of the estimated cost or accepted tender cost whichever is<br />
higher.<br />
21. SIGNING OF AGREEMENT:<br />
The agreement with the successful bidder shall have to be signed by the<br />
contractor BSNL with<strong>in</strong> 10 (ten) days of issue of LOI.<br />
