(The inclusion of property owned by the UnitedStates in this definition shall not limit assimilation of <strong>North</strong> <strong>Carolina</strong> law whenapplicable under the provisions of Title 18, United States Code, section 13).The term “public vehicular” area shall also include any beach area used by the public forvehicular traffic as well as any road opened to vehicular traffic within or leading to asubdivision for use by subdivision residents, their guests, and members of the public,whether or not the subdivision roads have been offered for dedication to the public.The term “public vehicular area” shall not be construed to mean any private property notgenerally open to and used by the public. <strong>Report</strong> on a PVA should contain the sameinformation as if the crash occurred on the roadway.Railway Grade CrossingRailway Grade Crossing: an intersection between a roadway and train tracks whichcross each other at the same level (grade).Railway Train: any device, with or without cars coupled thereto, designed for transportupon a railway, including any device designed to operate upon railway tracks, under itsown power, such as a motor vehicle equipped with flanged wheels. Nonmotorizeddevices, not set in motion by a railway train or vehicle, are not considered to be a railwaytrain or vehicle.Relation to Roadway: the location of the first harmful event as it relates to its positionwithin or outside the trafficway.Road: that part of a trafficway which includes both the roadway and anyshoulder alongside the roadway.Road Vehicle: is any land vehicle other than a railway vehicle, including motor vehiclesand other road vehicles.Roadway: that part of a trafficway designed, improved, and ordinarily used for vehiculartravel. In the event the trafficway includes two or more separate roadways, the term“roadway” refers to any such roadway separately, but not to all such roadwayscollectively.School Bus: a motor vehicle used for the transportation of any school pupil at or belowthe 12 th -grade level to or from a public or private school or school-related activity. Itmust be externally identifiable by the color yellow, the words “school bus”, flashing redlights located on the front and rear, and identifying lettering on both sides indicating theschool or school district served, or the company operating the bus.School Bus Related <strong>Crash</strong>: a motor vehicle crash in which a school bus, with or withouta pupil on board, is involved directly as a contact vehicle or indirectly as a noncontactvehicle.School Zone Signs: signs which change the speed limit on roads adjacent to schools onschool days, signs which give advance warning of school and signs which warn ofchildren crossing the road.Seating Position: location of occupant within a vehicle or on a motorcycle._____________________________________________________________________________________________Page 82<strong>North</strong> <strong>Carolina</strong> DMV-349 <strong>Crash</strong> <strong>Report</strong> <strong>Instruction</strong> <strong>Manual</strong>
