The <str<strong>on</strong>g>report</str<strong>on</strong>g> further provides the status of documented <str<strong>on</strong>g>groundwater</str<strong>on</strong>g> c<strong>on</strong>taminati<strong>on</strong> reas<strong>on</strong>ably suspected ofhaving been caused by activities regulated by state agencies. Groundwater c<strong>on</strong>taminati<strong>on</strong> is broadly definedin the <str<strong>on</strong>g>report</str<strong>on</strong>g> as any detrimental alterati<strong>on</strong> of the naturally occurring quality of <str<strong>on</strong>g>groundwater</str<strong>on</strong>g>. It is limited,however, to c<strong>on</strong>taminati<strong>on</strong> suspected of being associated with activities under the jurisdicti<strong>on</strong> of thec<strong>on</strong>tributing agencies and affecting usable-quality <str<strong>on</strong>g>groundwater</str<strong>on</strong>g>. Naturally occurring <str<strong>on</strong>g>groundwater</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong>s,such as a high degree of mineralizati<strong>on</strong> which may exceed established standards for public supplies ofdrinking water, are not included. The scope of the <str<strong>on</strong>g>report</str<strong>on</strong>g> is further limited to <str<strong>on</strong>g>groundwater</str<strong>on</strong>g> c<strong>on</strong>taminati<strong>on</strong>which has been documented and to cases which are of relatively recent origin or are currently underenforcement acti<strong>on</strong> of some kind. Historical cases of documented c<strong>on</strong>taminati<strong>on</strong> have not been includedunless enforcement acti<strong>on</strong> is still pending.The <str<strong>on</strong>g>report</str<strong>on</strong>g> provides technical and administrative agency file numbers and file locati<strong>on</strong>s for <str<strong>on</strong>g>groundwater</str<strong>on</strong>g>c<strong>on</strong>taminati<strong>on</strong> cases, field office locati<strong>on</strong>s, and agency c<strong>on</strong>tacts to assist interested users of the <str<strong>on</strong>g>report</str<strong>on</strong>g> inobtaining or reviewing case-specific data. In additi<strong>on</strong>, the <str<strong>on</strong>g>report</str<strong>on</strong>g> provides background informati<strong>on</strong> <strong>on</strong>m<strong>on</strong>itoring and regulatory rules and policies. This informati<strong>on</strong> is compiled to assist the public and statepolicy makers in interpreting the current status of <str<strong>on</strong>g>groundwater</str<strong>on</strong>g> c<strong>on</strong>taminati<strong>on</strong> in the state and the degree ofstate agency resp<strong>on</strong>se.The <str<strong>on</strong>g>report</str<strong>on</strong>g> satisfies the legislative intent of §26.406 of the <str<strong>on</strong>g>Texas</str<strong>on</strong>g> Water Code, but must be interpreted in lightof the specific geographic c<strong>on</strong>straints and the specific enforcement authorities and procedures of eachc<strong>on</strong>tributing entity. The c<strong>on</strong>clusi<strong>on</strong>s regarding <str<strong>on</strong>g>groundwater</str<strong>on</strong>g> c<strong>on</strong>taminati<strong>on</strong> and the specific enforcementacti<strong>on</strong>s taken have been made by each individual agency and are not subject to the review of the TGPC.Notificati<strong>on</strong> to Local Officials and PublicInformati<strong>on</strong>This <str<strong>on</strong>g>report</str<strong>on</strong>g> is compiled and made available to the public to provide the annual status of <str<strong>on</strong>g>groundwater</str<strong>on</strong>g>m<strong>on</strong>itoring associated with state agency activities and the annual status of documented <str<strong>on</strong>g>groundwater</str<strong>on</strong>g>c<strong>on</strong>taminati<strong>on</strong> reas<strong>on</strong>ably suspected of having been caused by those activities. M<strong>on</strong>itoring is discussed in theindividual program descripti<strong>on</strong>s and a tabulati<strong>on</strong> of all <str<strong>on</strong>g>groundwater</str<strong>on</strong>g> c<strong>on</strong>taminati<strong>on</strong> cases documented orunder enforcement during 1997 are listed. State law (§26.406 of the <str<strong>on</strong>g>Texas</str<strong>on</strong>g> Water Code) requires the agencieswhich have <str<strong>on</strong>g>groundwater</str<strong>on</strong>g> protecti<strong>on</strong> resp<strong>on</strong>sibilities maintain a public file of all documented cases of<str<strong>on</strong>g>groundwater</str<strong>on</strong>g> c<strong>on</strong>taminati<strong>on</strong>. This informati<strong>on</strong> is a matter of public record and is available for public reviewby arrangement with each agency.Table 1 identifies cases for which the TNRCC is required, by §5.236 of the <str<strong>on</strong>g>Texas</str<strong>on</strong>g> Water Code, to providenotice to local officials regarding <str<strong>on</strong>g>groundwater</str<strong>on</strong>g> c<strong>on</strong>taminati<strong>on</strong> which may affect drinking water supplies intheir area. This <str<strong>on</strong>g>report</str<strong>on</strong>g> serves as the TNRCC’s sec<strong>on</strong>dary notice to local officials regarding newly c<strong>on</strong>firmedcases meeting this criteria. This <str<strong>on</strong>g>report</str<strong>on</strong>g> addresses the requirement of §5.236 of the <str<strong>on</strong>g>Texas</str<strong>on</strong>g> Water Code bydistinguishing new cases of c<strong>on</strong>taminati<strong>on</strong> (since the compilati<strong>on</strong> of the previous <str<strong>on</strong>g>report</str<strong>on</strong>g>) which have affectedor could potentially affect drinking water supplies. The <str<strong>on</strong>g>report</str<strong>on</strong>g> is provided to county judges and county healthentities to supply informati<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>groundwater</str<strong>on</strong>g> impacts to drinking water supplies within the county. Secti<strong>on</strong>5.236 cases are identified in the <str<strong>on</strong>g>report</str<strong>on</strong>g> <strong>on</strong>ly for the year the case was <str<strong>on</strong>g>report</str<strong>on</strong>g>ed. There are 20 §5.236 casesidentified in Table 1.2
