Industrial and Hazardous Waste Divisi<strong>on</strong>Program Descripti<strong>on</strong>. The Industrial and Hazardous Waste (IHW) Divisi<strong>on</strong> regulates the disposal ofhazardous and n<strong>on</strong>-hazardous industrial solid waste and hazardous municipal waste under the authority of the<str<strong>on</strong>g>Texas</str<strong>on</strong>g> Solid Waste Disposal Act, as amended (Chapter 361, <str<strong>on</strong>g>Texas</str<strong>on</strong>g> Health and Safety Code), and underfederal authorizati<strong>on</strong> to administer the federal Resource C<strong>on</strong>servati<strong>on</strong> and Recovery Act (RCRA), asamended. The IHW Divisi<strong>on</strong> also regulates radioactive waste disposal program under the authority of the<str<strong>on</strong>g>Texas</str<strong>on</strong>g> Radiati<strong>on</strong> C<strong>on</strong>trol Act, as amended (Chapter 401, <str<strong>on</strong>g>Texas</str<strong>on</strong>g> Health and Safety Code), and under thefederal authorizati<strong>on</strong> of the Atomic Energy Act of 1954, as amended. The uranium mining and millinglicensing program was transferred to the <str<strong>on</strong>g>Texas</str<strong>on</strong>g> Department of Health in July, 1997; c<strong>on</strong>sequently<str<strong>on</strong>g>groundwater</str<strong>on</strong>g> m<strong>on</strong>itoring requirements and c<strong>on</strong>taminati<strong>on</strong> events previously <str<strong>on</strong>g>report</str<strong>on</strong>g>ed at those sites are nol<strong>on</strong>ger included in this <str<strong>on</strong>g>report</str<strong>on</strong>g>. In additi<strong>on</strong> to operating federally-authorized programs, the IHW Divisi<strong>on</strong> alsorefers cases to the Enforcement Divisi<strong>on</strong>/Waste Secti<strong>on</strong> when they involve violati<strong>on</strong>s of §26.121 of the <str<strong>on</strong>g>Texas</str<strong>on</strong>g>Water Code, which prohibits unauthorized discharges into or adjacent to waters in the state, including<str<strong>on</strong>g>groundwater</str<strong>on</strong>g>.Under RCRA authorizati<strong>on</strong>, the IHW Divisi<strong>on</strong> regulates the <str<strong>on</strong>g>groundwater</str<strong>on</strong>g> m<strong>on</strong>itoring programs (Detecti<strong>on</strong>,Compliance and Corrective Acti<strong>on</strong> Programs) of approximately 250 industrial facilities with land disposalunits. Land disposal units subject to regulati<strong>on</strong> include landfills, landfill spill sites where c<strong>on</strong>taminati<strong>on</strong> is notremoved, surface impoundments, land treatment units, and waste piles. M<strong>on</strong>itoring of <str<strong>on</strong>g>groundwater</str<strong>on</strong>g> quality inthe uppermost aquifer beneath these units is achieved through the combined efforts of the IHW Divisi<strong>on</strong>(Permits Secti<strong>on</strong>, Underground Injecti<strong>on</strong> C<strong>on</strong>trol, and Radioactive Waste Secti<strong>on</strong>), Enforcement Divisi<strong>on</strong>(Waste Secti<strong>on</strong>), and the Polluti<strong>on</strong> Cleanup Divisi<strong>on</strong> (Corrective Acti<strong>on</strong> Secti<strong>on</strong>).Program Descripti<strong>on</strong>s. More than <strong>on</strong>e type of m<strong>on</strong>itoring program can be required at a facility, depending<strong>on</strong> the number, age, and locati<strong>on</strong> of land disposal units and the applicable regulatory programs. Essentially, asmany as seven distinct m<strong>on</strong>itoring programs could be required at an industrial facility as a result of changesin the hazardous and solid waste program over time for the facility. A summary of major programs andprogram changes follows.Prior to 1981, m<strong>on</strong>itoring at solid waste sites was required: 1) by permit for off-site commercial disposalfacilities; 2) pursuant to an informati<strong>on</strong> request to complete a solid waste registrati<strong>on</strong> for <strong>on</strong>-site n<strong>on</strong>commercialdisposal facilities; or 3) in resp<strong>on</strong>se to enforcement directives. M<strong>on</strong>itoring requirements were notstandardized.Since November 19, 1981, all <strong>on</strong>-site disposal facilities subject to RCRA have been required by agency rulesto c<strong>on</strong>duct a standardized detecti<strong>on</strong> m<strong>on</strong>itoring program (Program No. 1) during the interim status perioduntil such time as a permit with site-specific m<strong>on</strong>itoring requirements is issued, or the waste facility is closedby removal of hazardous waste and c<strong>on</strong>taminati<strong>on</strong> to levels protective of human health and the envir<strong>on</strong>ment.Unless specific variances are granted, this program requires all operators to sample for a standard suite ofparameters and to perform the same statistical evaluati<strong>on</strong> of the results. When a release is indicated, theoperator implements an assessment m<strong>on</strong>itoring program (Program No. 2) designed to determine thecompositi<strong>on</strong> and extent of the release.Once permitted, an operator c<strong>on</strong>tinues to m<strong>on</strong>itor the waste units according to provisi<strong>on</strong>s in the facility'spermit. A permitted detecti<strong>on</strong> m<strong>on</strong>itoring program (Program No. 3) is specified for units for which no releasehas been indicated. The sampling program is based <strong>on</strong> hazardous c<strong>on</strong>stituents specific to the waste beingdisposed. Should a release occur, the operator implements a compliance m<strong>on</strong>itoring program (Program No. 4)35
