Groundwater contamination is defined as any detrimental alteration of the naturally occurring quality of<strong>groundwater</strong>. It is limited, however, to contamination suspected of being associated with activities underthe jurisdiction of the contributing agencies and affecting usable quality <strong>groundwater</strong>.< Enforcement action is defined very broadly to include any action of an agency which accomplishes orrequires the identification, documentation, monitoring, assessing, or remediation of <strong>groundwater</strong>contamination.Using the Contamination Case Description TablesThe <strong>groundwater</strong> contamination case descriptions are presented in a tabular format for contributing agencieswith enforcement authority over current <strong>groundwater</strong> contamination cases. The regulatory protection of<strong>groundwater</strong> is primarily the responsibility of the TNRCC. Certain activities requiring the regulatoryprotection of <strong>groundwater</strong> are under the jurisdiction of the Railroad <strong>Commission</strong> of <strong>Texas</strong>, the <strong>Texas</strong>Department of Agriculture, and the <strong>Texas</strong> State Soil and Water Conservation Board. The <strong>Texas</strong> Alliance ofGroundwater Districts has no regulatory or enforcement authority as an organization, but individual<strong>groundwater</strong> conservation districts may have limited authority for action with regard to <strong>groundwater</strong>contamination.Groundwater contamination case descriptions for the TNRCC, Railroad <strong>Commission</strong> of <strong>Texas</strong>, and memberdistricts of the <strong>Texas</strong> Alliance of Groundwater Districts are listed in Table 1 through Table 3, respectively.No contamination cases were <strong>report</strong>ed or under enforcement by the <strong>Texas</strong> State Soil and Water ConservationBoard or by the <strong>Texas</strong> Department of Agriculture in 1997.Locating Specific CasesThe first page of each agency’s table contains a legend of the column headings and a brief description of eachheading. The legend describes attributes that may be unique to that particular table; however, some of theheading descriptions repeat the field definitions given in this section. The contamination cases are groupedaccording to the county in which the contamination site is located, with a secondary grouping according todivision or specific regulatory program within an agency.To find a specific contamination case, locate the county of interest in the far left portion of the table. For thatagency, all documented contamination cases for that county are listed under the respective division orregulatory program heading which has jurisdiction over that case. Under each division heading, contaminationcase descriptions are listed in alphabetical order according to file names. Check each division or regulatoryprogram heading for the desired contamination case description. Also, check the other agency tables for thedesired contamination case descriptions for the county of interest. A location reference is provided in thetables under the field heading LOCATION and can be used to locate a specific case if the file name isunknown.24

Addresses field and laboratory qualityassurance procedures and data reliability and quality in determining conclusions foreach case.Included in Table 1 (only) to distinguish cases subject to notification requirementsunder §5.236 of the <strong>Texas</strong> Water Code. A "Y" code identifies cases in which3contamination has or may potentially affect a public drinking water supply. The "Y"code appears only in the <strong>report</strong> in which the case is listed as a new case (casesrequiring such notification identified in previous <strong>report</strong>s are not duplicated in this<strong>report</strong>).123File numbers can be used to access the files of the regulating agency to obtain data on each <strong>groundwater</strong>contamination case listed in Tables 1 through 3. Cases without file numbers may be accessed in theregulating agencies' files with the case file name.Some agencies do not have complete status codes due to insufficient data. Additionally, the regulatoryagencies <strong>report</strong>ing the contamination cases have procedures and internal structures that differ fromagency to agency. This makes it difficult to categorize enforcement or activity status under a generaldescription scheme. A more detailed explanation is given in the following section entitled EnforcementStatus Matrix.An entry in this field constitutes secondary notification from the TNRCC to local officials for cases<strong>report</strong>ed since the issuance of the previous <strong>report</strong>.25
