USER’S GUIDEThe remaining porti<strong>on</strong> of the <str<strong>on</strong>g>report</str<strong>on</strong>g> is divided into two secti<strong>on</strong>s. The first secti<strong>on</strong>, Groundwater Protecti<strong>on</strong>Program Descripti<strong>on</strong>s, provides a narrative, program-specific overview for each c<strong>on</strong>tributing agency ororganizati<strong>on</strong>. The sec<strong>on</strong>d secti<strong>on</strong>, Groundwater C<strong>on</strong>taminati<strong>on</strong> Case Descripti<strong>on</strong>s, c<strong>on</strong>tains a tabular listingof individual c<strong>on</strong>taminati<strong>on</strong> cases which were documented or under enforcement for calendar year 1997.Appendices are included at the end of the <str<strong>on</strong>g>report</str<strong>on</strong>g>, providing more detailed informati<strong>on</strong> supporting orsupplementing the main body of the <str<strong>on</strong>g>report</str<strong>on</strong>g>.Groundwater Protecti<strong>on</strong> Program Descripti<strong>on</strong>s. In this secti<strong>on</strong>, the specific regulatory programs of eachagency are described in terms of the activity or activities regulated, the standards and approvals required,m<strong>on</strong>itoring of the regulated entity's compliance with the c<strong>on</strong>diti<strong>on</strong>s of approval, m<strong>on</strong>itoring of <str<strong>on</strong>g>groundwater</str<strong>on</strong>g> todetect problems, and acti<strong>on</strong>s required if <str<strong>on</strong>g>groundwater</str<strong>on</strong>g> c<strong>on</strong>taminati<strong>on</strong> is discovered at a site or facility.The status of each program's required <str<strong>on</strong>g>groundwater</str<strong>on</strong>g> m<strong>on</strong>itoring is described and includes comments <strong>on</strong> qualityassurance policies and procedures and the number of facilities that are required to perform m<strong>on</strong>itoring. Thestatus of <str<strong>on</strong>g>groundwater</str<strong>on</strong>g> c<strong>on</strong>taminati<strong>on</strong> is described, and the informati<strong>on</strong> c<strong>on</strong>tained in the case descripti<strong>on</strong> tablefor each agency is summarized. Finally, special notes or comments specific to each program may be includedfor additi<strong>on</strong>al clarificati<strong>on</strong>.Groundwater C<strong>on</strong>taminati<strong>on</strong> Case Descripti<strong>on</strong>s. This secti<strong>on</strong> c<strong>on</strong>tains the individual <str<strong>on</strong>g>groundwater</str<strong>on</strong>g>c<strong>on</strong>taminati<strong>on</strong> case descripti<strong>on</strong>s for each c<strong>on</strong>tributing agency with regulatory <str<strong>on</strong>g>groundwater</str<strong>on</strong>g> protecti<strong>on</strong>authority. Each agency’s table lists c<strong>on</strong>taminati<strong>on</strong> cases by county and c<strong>on</strong>tains eight fields (columns) of dataspecific to each case.Rules and Definiti<strong>on</strong>s Related to ReportCompilati<strong>on</strong><str<strong>on</strong>g>Texas</str<strong>on</strong>g> Water Code, §26.406, authorized the TGPC to adopt rules defining the c<strong>on</strong>diti<strong>on</strong>s that c<strong>on</strong>stitute<str<strong>on</strong>g>groundwater</str<strong>on</strong>g> c<strong>on</strong>taminati<strong>on</strong> for the purpose of inclusi<strong>on</strong> of cases in its annual m<strong>on</strong>itoring and c<strong>on</strong>taminati<strong>on</strong><str<strong>on</strong>g>report</str<strong>on</strong>g> (Appendix 4). The TGPC adopted rules (Title 31, <str<strong>on</strong>g>Texas</str<strong>on</strong>g> Administrative Code, §§601.1 through601.5) <strong>on</strong> March 5, 1991, defining certain terms and c<strong>on</strong>diti<strong>on</strong>s that c<strong>on</strong>stitute <str<strong>on</strong>g>groundwater</str<strong>on</strong>g> c<strong>on</strong>taminati<strong>on</strong>for the purpose of the <str<strong>on</strong>g>report</str<strong>on</strong>g>. The TGPC rules became effective <strong>on</strong> March 29, 1991, adopted without changesfrom the proposed rules (published in the January 22, 1991 <str<strong>on</strong>g>Texas</str<strong>on</strong>g> Register).It was necessary to define <str<strong>on</strong>g>groundwater</str<strong>on</strong>g>, <str<strong>on</strong>g>groundwater</str<strong>on</strong>g> c<strong>on</strong>taminati<strong>on</strong> and enforcement acti<strong>on</strong> in broad terms sothat the varying jurisdicti<strong>on</strong>al abilities and programs of the c<strong>on</strong>tributing agencies could be compiled in similarformats and compared. Broad definiti<strong>on</strong>s also enable the <str<strong>on</strong>g>report</str<strong>on</strong>g> to include the largest possible universe ofdocumented c<strong>on</strong>taminati<strong>on</strong> from man-induced activities.< Groundwater is defined as water existing below the land surface in a z<strong>on</strong>e of saturati<strong>on</strong>, that is, the waterwhich completely fills the interc<strong>on</strong>nected pore spaces of the rock or sediment.23
