Reporting Historic ContaminationThe TNRCC’s notification requirements under the Spill Prevention and Control Rules are not applicable tocases of historic contamination. Historical contamination is not considered attributable to any presentlyoccurring or known discharge or spill incident. Based upon a number of inquiries and requests, the TNRCCbelieves there is a need to document the location and nature of historical contamination discovered duringroutine site assessments and any other investigation that documents contamination on land or to water(including <strong>groundwater</strong>). The TNRCC wishes to maintain a clear distinction and prevent duplication of effortbetween addressing ongoing discharges or spills requiring immediate response and cleanup to remove orprevent contamination from entering surface or <strong>groundwater</strong>s, and addressing <strong>report</strong>s of historicalcontamination that are not an immediate threat to surface or <strong>groundwater</strong>s.It is recommended that the person or entity discovering historical contamination submit written notification tothe appropriate TNRCC Regional Manager (Appendix 6) and the Emergency Response Manager (at MC-142, P.O. Box 13087, Austin, <strong>Texas</strong> 78711-3087) within 10 working days of discovery. Discovery ofhistorical contamination can occur either through observation or through receipt of analytical sampling data.It is suggested notification include the address and exact location of historical contamination, the date andmethod of discovery, the nature of the historical contamination, an estimate of the extent of contamination,possible sources if any can be determined, the current property owner and/or operator of the site of thecontamination and any other appropriate information. In the determination that the discovery of historicalcontamination indicates the presence of imminent and substantial endangerment, the appropriate TNRCCRegional Manager (Appendix 6) and the Emergency Response Center (at 512/463-7727) should be contactedwithin one hour.Public InformationThe purpose of this document is to compile and make available to the public an annual <strong>report</strong> which providesthe status of <strong>groundwater</strong> monitoring associated with the activities regulated by the contributing stateagencies. The <strong>report</strong> further provides an annual status of documented <strong>groundwater</strong> contamination, includingnew cases and previous cases still undergoing enforcement actions, reasonably suspected of having beencaused by activities regulated by the state agencies. Tables 1 through 3 provide a summarized tabulation ofall <strong>groundwater</strong> contamination cases documented or under enforcement during 1997. Limited informationpertaining to specific contamination cases listed in this <strong>report</strong> may be available by contacting appropriateagency personnel as listed in Appendix 7.Each agency, or more specifically, individual programs within an agency, may be required by statute, rule, orpolicy to provide notification of <strong>groundwater</strong> contamination once it has been confirmed through <strong>groundwater</strong>studies or validation of analyses. Notification may be required within a program to assorted individuals whichmay include local officials and health officers; public water suppliers and water well drillers; complainants; oraffected, or possibly affected, parties. Such requirements are commonly based on the need to minimizepotential adverse impacts to public health.Regulatory Notification to Local OfficialsSection 5.236 of the <strong>Texas</strong> Water Code requires the TNRCC to provide notice to local officials regarding<strong>groundwater</strong> contamination which may affect drinking water supplies in their area. Notification is provided to20
county judges and county health entities to supply information on <strong>groundwater</strong> impacts to drinking watersupplies within the county. Typically, these cases are identified in the <strong>report</strong> only during the year the case was<strong>report</strong>ed as new.The identified cases requiring notification under §5.236 are indicated in the field "SECTION 5.236" in theTNRCC’s <strong>groundwater</strong> contamination case table (Table 1). There are twenty §5.236 cases listed in this<strong>report</strong>. In previous <strong>report</strong>s prepared by the TGPC, a total of 640 §5.236 cases have been identified (listed asHB 938 cases prior to 1995); 16 in 1996, 15 in 1995, 42 in 1994, 15 in 1993, 41 in 1992, and 507 in 1991.The large number of §5.236 cases listed in the 1991 <strong>report</strong> included all such cases identified up to March 31,1992.State Agencies' Files<strong>Texas</strong> Water Code, §26.406 requires that the state agencies identified as having <strong>groundwater</strong> protectionresponsibilities maintain a public file of all documented cases of <strong>groundwater</strong> contamination. Each stateagency has its own location and specific procedures for maintenance and accessibility of information relatedto <strong>groundwater</strong> contamination cases. Each regulatory program within an agency may have a unique systemfor maintenance and identification of information related to contamination cases. Information on agency filesfor each program with <strong>groundwater</strong> contamination cases tabulated within this <strong>report</strong> are provided inAppendix 8 (Agency Central Records Locations). This information is a matter of public record and isavailable for public review by arrangement with each agency. In some situations, the availability ofinformation for certain enforcement actions may be limited or subject to specific access procedures. Inaddition, agency district and regional office locations are given in Appendix 6 and agency and districtcontacts are listed in Appendix 7.Other Reports and PublicationsThere are numerous water-agency publications which address <strong>groundwater</strong> contamination in the state. Thesepublications provide a different focus or perspective on <strong>groundwater</strong> quality conditions and presentinformation not contained within this <strong>report</strong>. Other publications provide information on statewide<strong>groundwater</strong> protection efforts and specific protection programs. Brief descriptions of several of thesepublications are provided in Appendix 9.There are eight predecessors to this Joint Groundwater Monitoring and Contamination Report. These<strong>report</strong>s, which cover calendar years 1989 through 1996, were produced annually by the TGPC and publishedby the TNRCC (and its predecessor agency, the <strong>Texas</strong> Water <strong>Commission</strong>). These <strong>report</strong>s provide abackground on the evolution of the state’s <strong>groundwater</strong> protection programs. The <strong>report</strong>s may also provideinsight to historical cases of contamination (cases which are no longer listed).The State of <strong>Texas</strong> Water Quality Inventory - 13th Edition (TNRCC, 1996) describes the conditions of thestate’s surface and <strong>groundwater</strong> quality. The state’s <strong>groundwater</strong> protection program is described and themajor documented and potential sources of <strong>groundwater</strong> contamination are identified.The Annotated Bibliography of <strong>Texas</strong> Water Resources Reports of the <strong>Texas</strong> Water Development Boardand the United States Geological Survey through August 1974 (TWDB, 1976) lists, with a brief summary,21
