Status of Groundwater M<strong>on</strong>itoring Programs. The Compliance Support Divisi<strong>on</strong>’s c<strong>on</strong>taminati<strong>on</strong>investigati<strong>on</strong> program is generally a complaint resp<strong>on</strong>se program. The programs in the divisi<strong>on</strong> do notinvolve the m<strong>on</strong>itoring of <str<strong>on</strong>g>groundwater</str<strong>on</strong>g> in associati<strong>on</strong> with a regulated activity in order to detectc<strong>on</strong>taminati<strong>on</strong>. When appropriate during certain remediati<strong>on</strong> or enforcement activities involving<str<strong>on</strong>g>groundwater</str<strong>on</strong>g> c<strong>on</strong>taminati<strong>on</strong>, the TNRCC may perform or require <str<strong>on</strong>g>groundwater</str<strong>on</strong>g> m<strong>on</strong>itoring to evaluateremediati<strong>on</strong> progress or success.Status of Groundwater C<strong>on</strong>taminati<strong>on</strong>. The Compliance Support Divisi<strong>on</strong> is providing technicalassistance <strong>on</strong> more than 126 OSSF cases. N<strong>on</strong>e of these cases currently involve m<strong>on</strong>itoring for <str<strong>on</strong>g>groundwater</str<strong>on</strong>g>c<strong>on</strong>taminati<strong>on</strong>. C<strong>on</strong>structi<strong>on</strong> of an OSSF treatment and disposal system must be isolated from certain areassuch as water wells, lakes, roads, and other objects subject to c<strong>on</strong>taminati<strong>on</strong> from the OSSF or which mayprevent the proper operati<strong>on</strong> of the system. Additi<strong>on</strong>ally, no individual may install, c<strong>on</strong>struct, alter, extend,or repair an OSSF unless the individual holds a valid certificati<strong>on</strong> issued by the executive director of theTNRCC or has a valid exempti<strong>on</strong>.Enforcement Divisi<strong>on</strong>Program Descripti<strong>on</strong>. The Enforcement Divisi<strong>on</strong> was created <strong>on</strong> September 1, 1995, to centralize theTNRCC’s enforcement activities into a single divisi<strong>on</strong>. The Enforcement Divisi<strong>on</strong> now c<strong>on</strong>tains threesecti<strong>on</strong>s: Air, Water, and Waste.Although the Waste Secti<strong>on</strong> of the Enforcement Divisi<strong>on</strong> is resp<strong>on</strong>sible for enforcement issues that involvethe Industrial and Hazardous Waste (IHW), Municipal Solid Waste, and Petroleum Storage Tank programareas, <strong>on</strong>ly IHW sites are listed under the Enforcement Divisi<strong>on</strong>’s jurisdicti<strong>on</strong> in this <str<strong>on</strong>g>report</str<strong>on</strong>g>. Groundwatern<strong>on</strong>compliances addressed by the Waste Secti<strong>on</strong> include violati<strong>on</strong>s of §26.121 of the <str<strong>on</strong>g>Texas</str<strong>on</strong>g> Water Codewhich prohibits unauthorized discharges into or adjacent to any water in the state.The Water Secti<strong>on</strong> of the Enforcement Divisi<strong>on</strong> coordinates the development of all n<strong>on</strong>compliance cases forthe Agriculture, Watershed Management, and Water Utilities programs. The secti<strong>on</strong> enforces water qualityprotecti<strong>on</strong> provisi<strong>on</strong>s under the <str<strong>on</strong>g>Texas</str<strong>on</strong>g> Water Code, <str<strong>on</strong>g>Texas</str<strong>on</strong>g> Health and Safety Code, state rules, water qualitypermits, and orders issued by the TNRCC.Both secti<strong>on</strong>s track n<strong>on</strong>compliances, issue agreed orders, and pursue litigati<strong>on</strong> in extreme cases through theOffice of the <str<strong>on</strong>g>Texas</str<strong>on</strong>g> Attorney General.Status of Groundwater M<strong>on</strong>itoring Programs. The Waste Secti<strong>on</strong> oversees approximately 200 sites thatare required to m<strong>on</strong>itor <str<strong>on</strong>g>groundwater</str<strong>on</strong>g> c<strong>on</strong>taminati<strong>on</strong> in accordance with the <str<strong>on</strong>g>Texas</str<strong>on</strong>g> Administrative Code orRCRA regulati<strong>on</strong>s.The Water Secti<strong>on</strong> currently provides enforcement support for 10 active Water Quality Divisi<strong>on</strong> cases thatare either in a planning, assessing, <str<strong>on</strong>g>report</str<strong>on</strong>g>ing, or remediati<strong>on</strong> phase. The active enforcement cases involvedocumented violati<strong>on</strong>s of the Water Code, permits, orders, or rules that have the potential to cause<str<strong>on</strong>g>groundwater</str<strong>on</strong>g> c<strong>on</strong>taminati<strong>on</strong>.Status of Groundwater C<strong>on</strong>taminati<strong>on</strong>. The Waste Secti<strong>on</strong> of the Enforcement Divisi<strong>on</strong> has included 178cases with c<strong>on</strong>firmed <str<strong>on</strong>g>groundwater</str<strong>on</strong>g> c<strong>on</strong>taminati<strong>on</strong> in Table 1 of this <str<strong>on</strong>g>report</str<strong>on</strong>g> under the heading “ENF/WST.”Sixteen of the cases are new in 1997. Twenty-two of the facilities have impacted water wells; however, n<strong>on</strong>e33
