Subsequent samples were taken quarterly, semi-annually, or annually, as required inthe facilities’ permits or by the GWMT, and were analyzed for an abbreviated number of parameters. Sitesthat closed prior to the October 9, 1993, or April 9, 1994, deadlines are presently following theserequirements during their post-closure care periods.The RCRA Subtitle D <str<strong>on</strong>g>groundwater</str<strong>on</strong>g> m<strong>on</strong>itoring requirements are phased in for active landfills based <strong>on</strong>proximity to the nearest drinking water intake (including any surface water intake, domestic well, publicwater supply well, etc. utilized for human c<strong>on</strong>sumpti<strong>on</strong>). These requirements include the following: athorough <str<strong>on</strong>g>groundwater</str<strong>on</strong>g> characterizati<strong>on</strong> study; an approved certificati<strong>on</strong> of the site's <str<strong>on</strong>g>groundwater</str<strong>on</strong>g> m<strong>on</strong>itoringsystem; an approved Groundwater Sampling and Analysis Plan (GWSAP); a modified and expanded list ofanalytical parameters including 47 volatile organic compounds; at least four background sampling events[depending <strong>on</strong> the statistical method(s) utilized]; a semiannual sampling schedule during detecti<strong>on</strong>m<strong>on</strong>itoring; and, statistical analysis of <str<strong>on</strong>g>groundwater</str<strong>on</strong>g> analytical data. An annual sampling schedule may beallowed under certain c<strong>on</strong>diti<strong>on</strong>s.Prior to the Subtitle D rules, when <str<strong>on</strong>g>groundwater</str<strong>on</strong>g> analyses indicated a departure from background or historicallevels, or if other evidence of possible c<strong>on</strong>taminati<strong>on</strong> was present, the GWMT required re-sampling ofexisting m<strong>on</strong>itor wells, often including additi<strong>on</strong>al analytical parameters. If further investigati<strong>on</strong> indicatedprobable c<strong>on</strong>taminati<strong>on</strong>, the permittee was required to initiate a remedial investigati<strong>on</strong>, potentially leading tocorrective acti<strong>on</strong> and/or remediati<strong>on</strong>.Under the Subtitle D rules, the permittee c<strong>on</strong>ducts background m<strong>on</strong>itoring as prescribed in an approvedGWSAP. Up<strong>on</strong> completi<strong>on</strong> of background sampling, the permittee is required to c<strong>on</strong>duct detecti<strong>on</strong>m<strong>on</strong>itoring sampling and to initiate statistical analysis of the <str<strong>on</strong>g>groundwater</str<strong>on</strong>g> analytical data and to c<strong>on</strong>tinueperforming statistical analysis of the data in subsequent detecti<strong>on</strong> m<strong>on</strong>itoring events. If statistical analysisindicates that a statistically significant change (SSC) in c<strong>on</strong>stituent c<strong>on</strong>centrati<strong>on</strong>s has occurred frombackground c<strong>on</strong>centrati<strong>on</strong>s, the site must notify the TNRCC of the SSC. The facility may resample toc<strong>on</strong>firm the SSC and/or dem<strong>on</strong>strate within 90 days of the notificati<strong>on</strong> that the SSC has occurred due to asource other than the landfill. If the dem<strong>on</strong>strati<strong>on</strong> is not satisfactory, the owner/operator becomes subject tothe requirements of assessment m<strong>on</strong>itoring, which includes analysis for an expanded list of c<strong>on</strong>stituents. If<strong>on</strong>e or more assessment m<strong>on</strong>itoring c<strong>on</strong>stituents are detected at statistically significant levels aboveestablished <str<strong>on</strong>g>groundwater</str<strong>on</strong>g> protecti<strong>on</strong> standards [which could be maximum c<strong>on</strong>taminant levels (MCLs),background c<strong>on</strong>centrati<strong>on</strong>s, or health-based c<strong>on</strong>centrati<strong>on</strong>s] the owner/operator must initiate an assessment ofcorrective measures and must characterize the nature and extent of the release. At this time, the facility willbe added to the list of MSWLFs with known <str<strong>on</strong>g>groundwater</str<strong>on</strong>g> c<strong>on</strong>taminati<strong>on</strong>. After the assessment of correctivemeasures and before the selecti<strong>on</strong> of the remedy, the permittee is required to c<strong>on</strong>duct a public meeting todiscuss the results of the assessment of corrective measures with affected and interested parties. This, in turn,will lead to the selecti<strong>on</strong> of the remedy and the implementati<strong>on</strong> of the appropriate corrective acti<strong>on</strong>/remedialacti<strong>on</strong>.Status of Groundwater C<strong>on</strong>taminati<strong>on</strong>. Approximately 3,900 samples were collected from all the wellssampled in 1997. Groundwater c<strong>on</strong>taminati<strong>on</strong> has been c<strong>on</strong>firmed at the 26 MSWLF sites listed by county inTable 1 under the heading "MSW.” Of those 26 sites, c<strong>on</strong>taminati<strong>on</strong> has been found in approximately 144samples from an estimated 69 m<strong>on</strong>itor wells. N<strong>on</strong>e of the 26 c<strong>on</strong>taminati<strong>on</strong> cases are new and n<strong>on</strong>e of themrequired the notificati<strong>on</strong> of local officials under <str<strong>on</strong>g>Texas</str<strong>on</strong>g> Water Code, §5.236. Two sites listed in the 1996<str<strong>on</strong>g>report</str<strong>on</strong>g> were removed because acti<strong>on</strong>s were completed.41
