SUMMARYThe <strong>Texas</strong> Groundwater Protection Committee (TGPC) was created by the 71st <strong>Texas</strong> Legislature in 1989 tobridge gaps between existing state <strong>groundwater</strong> programs and to optimize water-quality protection byimproving coordination among agencies involved in <strong>groundwater</strong> activities. House Bill 1458, codified as§§26.401 through 26.407 of the <strong>Texas</strong> Water Code, sets out the state's <strong>groundwater</strong> protection policy,provides legislative recognition for the TGPC, requires the TGPC to coordinate the <strong>groundwater</strong>protection activities of state agencies, and requires the TGPC develop and update a comprehensive<strong>groundwater</strong> protection strategy for the state.State Law (§26.405 and §26.406 of the <strong>Texas</strong> Water Code) requires the TGPC to annually publish a <strong>report</strong>on <strong>groundwater</strong> monitoring activities and cases of documented contamination associated with activitiesregulated by state agencies. The TGPC is required to prepare this <strong>report</strong> based on the activities of the <strong>Texas</strong>Natural Resource Conservation <strong>Commission</strong> (TNRCC), the <strong>Texas</strong> Water Development Board, the Railroad<strong>Commission</strong> of <strong>Texas</strong> (RCT), the <strong>Texas</strong> Department of Health, the <strong>Texas</strong> Department of Agriculture, the<strong>Texas</strong> State Soil and Water Conservation Board, the <strong>Texas</strong> Alliance of Groundwater Districts, the <strong>Texas</strong>Agriculture Experiment Station, and the Bureau of Economic Geology of the University of <strong>Texas</strong> at Austin.State Law (§5.236 of the <strong>Texas</strong> Water Code) also requires the TNRCC provide notice to local officialsregarding <strong>groundwater</strong> contamination which may affect drinking water supplies in their area. The definitionsof <strong>report</strong>able cases under these two mandates are significantly different. As required by §26.406 of the <strong>Texas</strong>Water Code, the <strong>report</strong> tabulates all cases of <strong>groundwater</strong> contamination documented or under enforcementfor the preceding calendar year. The <strong>report</strong> further identifies those cases subject to notification under §5.236of the <strong>Texas</strong> Water Code for the preceding year in Table 1.This is the TGPC’s ninth edition of the Joint Groundwater Monitoring and Contamination Report. The<strong>report</strong> describes the current status of <strong>groundwater</strong> monitoring programs of each participating agency, anddescribes <strong>groundwater</strong> contamination cases documented or under enforcement during the 1997 calendar year.The <strong>report</strong> further describes the enforcement status of each case of <strong>groundwater</strong> contamination in theaccompanying tables.Purpose and Scope<strong>Texas</strong> Water Code, §26.406, requires the annual <strong>report</strong> to describe the current status of <strong>groundwater</strong>monitoring activities conducted by or required by each agency at regulated facilities or associated withregulated activities. The <strong>report</strong> is required to contain a description of each case of <strong>groundwater</strong> contaminationdocumented during the previous calendar year, and a description of each case of contamination documentedduring previous periods for which enforcement action was incomplete at the time of issuance of the preceding<strong>report</strong>. The <strong>report</strong> is also required to indicate the status of enforcement action for each listed case.This <strong>report</strong> compiles and makes available to the public the status of <strong>groundwater</strong> monitoring associated withactivities regulated or conducted by the contributing state agencies. Groundwater monitoring is conducted bystate agencies to assure regulatory compliance for <strong>groundwater</strong> protection and to assess ambient <strong>groundwater</strong>quality. The <strong>report</strong> provides a general overview of <strong>groundwater</strong> monitoring for the participating agencies on aprogram-by-program basis.1
