NATIONAL LABOR RELATIONS BOARDOrganization and FunctionsThe <strong>National</strong> <strong>Labor</strong> <strong>Relations</strong> <strong>Board</strong> is an independent agency created by the <strong>National</strong><strong>Labor</strong> <strong>Relations</strong> Act, enacted July 5, 1935 (49 Stat. 449; 29 U.S.C. 151–166); as amendedby the <strong>Labor</strong> Management <strong>Relations</strong> Act, 1947, enacted June 23, 1947 (61 Stat. 136; 29U.S.C. 151–166); as amended by an Act of October 21, 1951 (65 Stat. 601; 29 U.S.C.158, 159, 168); as amended by the <strong>Labor</strong>-Management Reporting and Disclosure Act of1959, enacted September 14, 1959 (73 Stat. 519; 29 U.S.C. 141, et seq.); and as amendedby an Act of July 26, 1974 (88 Stat. 395–397; 29 U.S.C. 152, et seq.). The responsibilitiesand functions of the Agency under the statutes are carried out through an organizationdirected and controlled by the <strong>National</strong> <strong>Labor</strong> <strong>Relations</strong> <strong>Board</strong> and its General Counsel,who, in addition to independent authority under the statute, exercises other authority bydelegation from the <strong>Board</strong>.PART 201—DESCRIPTION OF ORGANIZATIONSUBPART A—DESCRIPTION OF CENTRAL ORGANIZATIONSec. 201 The <strong>Board</strong>. The <strong>Board</strong>, composed of five Members, has its central andprincipal office in Washington, D.C. Each of the Members is appointed by the President,with the approval of the Senate, for a term of 5 years. One Member is designated by thePresident to serve as Chairman of the <strong>Board</strong>. The <strong>Board</strong> is created by virtue of theprovisions of the <strong>National</strong> <strong>Labor</strong> <strong>Relations</strong> Act, 49 Stat. 449, as amended by the <strong>Labor</strong>Management <strong>Relations</strong> Act, 1947, 61 Stat. 136, and the <strong>Labor</strong> Management Reportingand Disclosure Act, 1959, 73 Stat. 519.The <strong>Board</strong> has two principal functions under the <strong>National</strong> <strong>Labor</strong> <strong>Relations</strong> Act: (1) Theprevention of statutorily defined unfair labor practices on the part of employers and labororganizations or the agents of either, and (2) the conduct of secret-ballot elections amongemployees in appropriate collective-bargaining units to determine whether or not theydesire to be represented by a labor organization.The <strong>Board</strong> is further empowered by the Act:To conduct secret-ballot elections among employees who have been covered by aunion-shop agreement, when requested by 30 percent of the employees, to determinewhether or not they wish to revoke their union’s authority to make such agreements.To determine in cases involving jurisdictional disputes which of the competing groupsof workers is to be assigned the work task involved.204
