Cell Tower Radiation Hazard: Need for Legislative Interventionhealth hazard. A bench comprising Chief Justice YKSabbarwal and Justice CK Thapper and RV Ravendranissued notices to ministries and stated that there areno lucid Government guidelines on issue.ConclusionThe legislative intervention on Radiation Emissionis desperate solution to the unchecked emissionproblem. Prior to that massive research,development and survey must be conducted sothat the actual deficiencies could be detected andhence a sound policy can be framed. Theprospective policy must also fix the maximum limitfor Radiation Emission depending on variousvariables. The reports of Radiation Emission fromvarious towers should be monitored and checkedby a specialized agency and the towers must beshared by telecommunication companies so thatthe environmental and cosmetic impact could bedecreased. The height of the tower, the survey ofcondition of Building (on which tower has to beinstalled), the distance of the tower from residentialareas, the safety standards, all these must becategorically included in the policy, so that there isa clear unitary approach towards it. The variousbye-laws and few case laws are bulky, andcomplicating the Judicial and Legislative action.The National policy would be a Central Idea to themost modem problem of our times or else it is adanger from which we have literally nowhere tohide.The Indian Police Journal Vol. LVII-No. 2, April-June, 2010 39➢
