Attachment 3Council <strong>of</strong> Ministers Resolutions – English VersionThe Council <strong>of</strong> Ministers decision to change resolutions from the <strong>National</strong> <strong>L<strong>and</strong></strong>Summit <strong>of</strong> 2006.The changes or additions <strong>of</strong> the Council <strong>of</strong> Ministers are Bolded (in blackwriting).<strong>L<strong>and</strong></strong> OwnershipResolution 1:Government to pass a law that all custom l<strong>and</strong> in <strong>Vanuatu</strong> is owned in accordancewith the traditional l<strong>and</strong> tenure system <strong>of</strong> each (wan-wan) isl<strong>and</strong>.Resolution 5:Every lease shall:1. Be in Bislama2. Involve all members <strong>of</strong> the l<strong>and</strong> owning group where l<strong>and</strong> is owned bygroups. (Man, Woman, <strong>and</strong> Youth).3. The Department <strong>of</strong> <strong>L<strong>and</strong></strong>s to explain to the custom owners, the terms <strong>and</strong>conditions <strong>of</strong> the lease <strong>and</strong> rights to their lease agreement.4. Include the value <strong>of</strong> l<strong>and</strong>, l<strong>and</strong> rent <strong>and</strong> premium, term <strong>of</strong> the lease, <strong>and</strong> rentreview.5. There is need for legal advice from the Public Solicitor or any other body assuch to help l<strong>and</strong> owners who have interest to lease their l<strong>and</strong>.6. In every lease agreement, Chiefs <strong>and</strong> Custom Owners must firstly agree(but not approved as a resolution from the Summit) to: Certificate <strong>of</strong> Negotiation Lease Agreement Any changes to the lease conditions ( use <strong>of</strong> l<strong>and</strong>, term <strong>of</strong> the lease)Resolution 7:Notice <strong>of</strong> every application to negotiate must go to the Chief <strong>and</strong> area TAG wherel<strong>and</strong> is located.Resolution 8:Every application to negotiate shall have1. Copy <strong>of</strong> a passport <strong>of</strong> a man or woman (if he or she is an investor outside <strong>of</strong><strong>Vanuatu</strong>)2. Copy <strong>of</strong> a VIPA certificate to show that he or she has the money to investon l<strong>and</strong>.The power <strong>of</strong> the Minister where l<strong>and</strong> is in disputeResolution 9:3
