<strong>Appendix</strong> A2. Violations and penalties. Any person who violates any of these regulations shall be subject to a fineof not more than five hundred dollars ($500.00) for each lot or parcel of land so subdivided or sold;such fine shall be pursuant to section 15.2-2254 of the Code of <strong>Virginia</strong>, (1950), as amended.3. Civil enforcement. Appropriate actions and proceedings may be taken in law or in equity to preventany violation of these regulations, to prevent unlawful construction, to recover damages, to restrain,correct, or abate a violation, and to prevent illegal occupancy of a building structure or premises.These remedies shall be in addition to the penalties described above.1.6Interpretation and separability.1. Interpretation. In their interpretation and application, of the provisions of these regulations shall beheld to be the minimum requirements for the promotion of the public health, safety, and generalwelfare. These regulations shall be construed broadly to promote the purposes for which they areadopted.a. Public provisions. These regulations are not intended to interfere with, abrogate, or annual anyother ordinance, rule or regulation, statute, or other provision of law except as provided in theseregulations. Where any provision of these regulations imposes restrictions different from thoseimposed by any other provision of these regulations or any other ordinance, rules or regulation,or other provision of law, the provision which is more restrictive or imposes higher standardsshall apply.b. Private provisions. These regulations are not intended to abrogate any easement, covenant, orany other private agreement or restriction, provided that where the provisions of theseregulations are more restrictive or impose higher standards or regulations than such easement,covenant, or other private agreement or restriction, the requirements of these regulations shallgovern. Private provisions, restrictions, or covenants are not enforced by the county.2. Separability. If any part or provision of these regulations or the application of these regulations to anyperson or circumstances is adjudged invalid by any court of competent jurisdiction, the judgmentshall be confined in its operation to the part, provision, or application directly involved in thecontroversy in which the judgment shall be rendered and it shall not affect or impair the validity of theremainder of these regulations or the application of them to other persons or circumstances. The<strong>Bedford</strong> <strong>County</strong> Board of Supervisors hereby declares that it would have enacted the remainder ofthese regulations even without any such part, provision, or application which is judged to be invalid.1.7Pending applications.All applications for subdivision approval, including final plats, pending on the effective date of theseregulations shall be reviewed under the regulations in effect at the time of plat submittal.1.8Saving provision.These regulations shall not be construed as abating any action now pending under, or by virtue of,prior existing subdivision regulations, or as discontinuing, abating, modifying, or altering any penaltyaccruing or about to accrue, or as affecting the liability of any person, firm, or corporation, or as waivingany right of the county under any section or provision existing at the time of adoption of these regulations,or as vacating or annulling any rights obtained by any person, firm, or corporation by lawful action of themunicipality except as shall be expressly provided for in these regulations.
