Appeal Board’s Powers<br />

W.78.<br />

The Appeal Board may give directions as it thinks fit for the future conduct of the appeal,<br />

addressed in writing to the parties, or require the parties to attend a directions hearing.<br />

Any party to an appeal may apply for permission to adduce fresh evidence. Such permission<br />

shall only be granted if it can be shown that the evidence was not available to the party and<br />

could not have been obtained by such party with reasonable diligence, at the time at which<br />

the Commission heard the complaint.<br />

Notice of the date, time and place of the appeal hearing shall be given in writing to the parties<br />

by the chairman of the Appeal Board.<br />

If a party fails, refuses or is unable to attend the hearing the Appeal Board may either adjourn<br />

it or proceed in the party’s absence.<br />

Except in cases in which the Appeal Board gives leave to adduce fresh evidence pursuant<br />

to Rule W.70, an appeal shall be by way of a review of the documents and the parties shall<br />

be entitled to make oral representations. Subject to the foregoing provisions of this Rule,<br />

the Appeal Board shall have an overriding discretion as to the manner in which the<br />

hearing is conducted.<br />

The Appeal Board may permit the Appellant (or Person, Club or club pursuant to Rule W.61.3)<br />

at any time to withdraw the appeal on such terms as to costs and otherwise as the Appeal<br />

Board shall determine.<br />

If the members of the Appeal Board are not unanimous, the decision of the majority of them<br />

shall prevail.<br />

The Appeal Board’s decision shall be announced as soon as practicable after the appeal<br />

hearing and if possible at the end thereof and shall be confirmed in writing by the chairman<br />

of the Appeal Board to the parties, giving reasons. If the decision reached by the Appeal<br />

Board was by a majority, no minority or dissenting opinion shall be produced or published.<br />

Members of an Appeal Board shall be entitled to receive from the League a reasonable sum<br />

by way of fees and expenses.<br />

Upon the hearing of an appeal, an Appeal Board may:<br />

W.78.1. allow the appeal;<br />

W.78.2. dismiss the appeal;<br />

W.78.3. except in the case of a fixed penalty, vary any penalty imposed or order made at<br />

first instance;<br />

W.78.4. vary or discharge any order for compensation made by the Commission;<br />

W.78.5. order the deposit to be forfeited to the League or repaid to the appellant;<br />

W.78.6. order a party to pay or contribute to the costs of the appeal including the fees and<br />

expenses of members of the Appeal Board paid or payable under Rule W.77;<br />

W.78.7. remit the matter back to the Commission with directions as to its future disposal;<br />

W.78.8. make such other order as it thinks fit.<br />
