give directions in relation to the preservation, custody, detention, inspection or<br />

photographing of property owned by or in the possession of a party to the<br />

proceedings;<br />

give directions as to the preservation of evidence in the custody or control of a<br />

party;<br />

direct that a witness be examined on oath;<br />

require each party to give notice of the identity of witnesses it intends to call;<br />

require exchange of witness statements and any expert’s reports;<br />

appoint one or more experts to report to it on specific issues;<br />

require a party to give any such expert any relevant information or to produce or<br />

provide access to any relevant documents or property;<br />

order that a transcript be taken of the proceedings;<br />

extend or abbreviate any time limits provided by this Section of these Rules or by<br />

its directions;<br />

require the parties to attend such procedural meetings as it deems necessary to<br />

identify or clarify the issues to be decided and the procedures to be adopted;<br />

give such other lawful directions as it shall deem necessary to ensure the just,<br />

expeditious, economical and final determination of the dispute.<br />

The parties shall do all things necessary for the proper and expeditious conduct of the<br />

arbitration and shall comply without delay with any direction of the chairman of the tribunal<br />

as to procedural or evidential matters.<br />

If either party is in breach of Rule X.22 the tribunal shall have power to:<br />

X.23.1. make peremptory orders prescribing a time for compliance;<br />

X.23.2. make orders against a party which fails to comply with a peremptory order;<br />

X.23.3. dismiss a claim for want of prosecution in the event of inordinate or inexcusable<br />

delay by a party which appears likely to give rise to a substantial risk that it will not<br />

be possible to have a fair resolution of the issues or will cause serious prejudice to<br />

the other party;<br />

X.23.4. debar that party from further participation and proceed with the arbitration and<br />

make an award but only after giving that party written notice of its intention to do so.<br />

The chairman shall fix the date, time and place of the arbitration hearing and shall give the<br />

parties reasonable notice thereof.<br />

At or before the hearing the chairman shall determine the order in which the parties shall<br />

present their cases.<br />
