<strong>FM</strong> 3-<strong>19.4</strong><br />

right of individuals in instances when they, their fellow<br />

soldiers, or personnel in their charge are threatened<br />

with death or serious bodily harm. NLW add flexibility<br />

to the control of disturbances within the I/R facility and<br />

provide an environment where guard forces can<br />

permissively engage threatening targets (Figure 3-2)<br />

with limited risk of noncombatant casualties and<br />

collateral damage. Refer to <strong>FM</strong> 90-40.<br />

3-20. The use of lethal force, employed under the<br />

standing ROE, will never be denied. At no time will<br />

forces be deployed without the ability to defend<br />

themselves against a lethal threat, nor will they forego<br />

normal training, arming, and equipping for combat.<br />

Nonlethal options are a complement to, not a<br />

replacement for, lethal force and seek to expand a<br />

proactive response across the range of military<br />

operations. Refer to <strong>FM</strong> 90-40.<br />

3-21. The decision to use NLW against an adversary<br />

during a confrontation is delegated to the lowest possible<br />

level, preferably to the platoon or the squad. However,<br />

this requires that all personnel, not just the leaders,<br />

have a clear understanding of the ROE and the<br />

commander’s intent. Refer to <strong>FM</strong> 90-40.<br />

3-22. Commanders and public affairs officers must be<br />

prepared to address media questions and concerns<br />

regarding the use and role of NLW, and they must make<br />

it clear that the presence of NLW in no way indicates<br />

abandoning the option to employ deadly force in<br />

appropriate circumstances.<br />

3-23. Advantages of Employing Nonlethal<br />

Weapons. NLW provide the commander with the<br />

flexibility to influence the situation favorably with<br />

reduced risk of noncombatant fatalities and collateral<br />

damage.<br />
