M<strong>in</strong>ority <strong>Youth</strong> <strong>in</strong> the <strong>Juvenile</strong> <strong>Justice</strong> <strong>System</strong> 7<br />

centers that offer constructive activities dur<strong>in</strong>g<br />

afternoons and early even<strong>in</strong>gs, so youth can<br />

stay at home and <strong>in</strong> school.<br />

• In California's Santa Cruz and Sacramento<br />

counties, JDAI worked to reduce high rates<br />

of m<strong>in</strong>ority detention that emphasized fast<br />

track case management and risk assessment<br />

screen<strong>in</strong>g tools. In Santa Cruz, a risk assessment<br />

<strong>in</strong>strument was used to deta<strong>in</strong> only high-risk<br />

offenders; alternative programs and procedures<br />

were developed for low- and medium-risk youth.<br />

Partnerships with community organizations to<br />

provide culturally responsive alternatives to<br />

detention were critical, such as recogniz<strong>in</strong>g the<br />

importance of hav<strong>in</strong>g a bil<strong>in</strong>gual staff and staff<br />

with close community ties and life experience<br />

that help them relate to youth, to facilitate<br />

prompt transfers from detention.<br />

Burns Institute<br />

<strong>The</strong> W. Haywood Burns Institute works to improve<br />

and protect the lives of m<strong>in</strong>ority youth by ensur<strong>in</strong>g<br />

fairness <strong>in</strong> juvenile justice systems. Focus<strong>in</strong>g on local<br />

sites, the Burns Institute <strong>in</strong>corporates neighborhood<br />

<strong>in</strong>volvement and stakeholder alliances to ensure that<br />

community representatives are directly supervis<strong>in</strong>g<br />

disproportionate m<strong>in</strong>ority contact reduction with<strong>in</strong><br />

their communities. <strong>The</strong> Burns Institute has worked<br />

<strong>in</strong> more than 30 jurisdictions nationally and has<br />

successfully reduced disparities. <strong>The</strong> Institute also<br />

established the Community <strong>Justice</strong> Network for<br />

<strong>Youth</strong> through 140 organizations <strong>in</strong> 21 states. Its<br />

mission is to promote the availability of effective,<br />

culturally appropriate <strong>in</strong>terventions for youth <strong>in</strong><br />

m<strong>in</strong>ority and poor communities.<br />

State Action<br />

Dur<strong>in</strong>g the 1990s, states began enact<strong>in</strong>g policies<br />

that prescribe methods for curb<strong>in</strong>g disproportionate<br />

m<strong>in</strong>ority contact. In 1993, Wash<strong>in</strong>gton became<br />

the first to pass such legislation by l<strong>in</strong>k<strong>in</strong>g county<br />

fund<strong>in</strong>g to programs that address overrepresentation,<br />

improv<strong>in</strong>g data collection, and implement<strong>in</strong>g<br />

cultural and ethnic tra<strong>in</strong><strong>in</strong>g for judges and<br />

juvenile court personnel. Subsequent Wash<strong>in</strong>gton<br />

laws required overrepresentation report<strong>in</strong>g by<br />

state agencies, implement<strong>in</strong>g pilot programs to<br />

reduce <strong>in</strong>equality <strong>in</strong> the juvenile prosecution, and<br />

develop<strong>in</strong>g detention screen<strong>in</strong>g <strong>in</strong>struments.<br />

Other states followed with similar efforts <strong>in</strong><br />

the late 1990s and early 2000s. In response to<br />

high disproportionate m<strong>in</strong>ority contact rates,<br />

Connecticut formed a 20-member <strong>in</strong>ter-branch<br />

Commission on Racial and Ethnic Disparity <strong>in</strong> the<br />

crim<strong>in</strong>al justice system to explore ways to reduce<br />

the number of <strong>African</strong>-<strong>American</strong>s and Lat<strong>in</strong>os <strong>in</strong><br />

the system, <strong>in</strong>clud<strong>in</strong>g the juvenile justice system. In<br />

North Carol<strong>in</strong>a, the Governor’s Crime Commission<br />

created a Disproportionate M<strong>in</strong>ority Contact<br />

Committee to evaluate overall disproportionate<br />

m<strong>in</strong>ority contact and make recommendations to<br />

reduce racial disparities.<br />

Missouri took steps to require the state court<br />

adm<strong>in</strong>istrator to develop standards, tra<strong>in</strong><strong>in</strong>g and<br />

assessment on racial disparities. Oregon established<br />

the Office of M<strong>in</strong>ority Services as an <strong>in</strong>dependent<br />

state agency and formed pilot programs to <strong>in</strong>itiate<br />

cultural competency tra<strong>in</strong><strong>in</strong>g and detention<br />

alternatives. Oregon is also <strong>in</strong> its tenth year of<br />

conduct<strong>in</strong>g an annual governor’s summit on<br />

m<strong>in</strong>ority overrepresentation <strong>in</strong> the juvenile justice<br />

system; attendees <strong>in</strong>clude judges, attorneys and<br />

others.<br />

Recent Activity<br />

In 2007, South Dakota established pilot programs<br />

<strong>in</strong> three cities to address disproportionate m<strong>in</strong>ority<br />

contact. <strong>The</strong> arrest rate for Native <strong>American</strong><br />

youth <strong>in</strong> South Dakota is almost two and one-half<br />

times greater than their white peers; they also are<br />

overrepresented <strong>in</strong> other areas of the state juvenile<br />

justice system. Federal fund<strong>in</strong>g from the JJDPA is<br />

help<strong>in</strong>g South Dakota implement the programs.<br />

<strong>The</strong>y focus on Native <strong>American</strong> cultural awareness<br />

and agency cultural assessment tra<strong>in</strong><strong>in</strong>g for juvenile<br />

justice practitioners and service providers.<br />
