(e) Maintenance obligations in cases of joint parental responsibility (parent and non-parent)<br />

and joint guardianship (article 1:2w and article 1:282, paragraph 6 in conjunction with<br />

article 1:253W Civil Co<strong>de</strong>).<br />

Stepparents: only when the stepchildren form part of the family and only during a<br />

marriage or registered partnership.<br />

(f) Maintenance obligations between spouses following a judicial separation (article 1:169,<br />

paragraph 2 in conjunction with article 157 Civil Co<strong>de</strong>).<br />

(g) Maintenance obligations of the biological father / life partner of the mother: if a child has<br />

a mother and no father, its biological father is un<strong>de</strong>r an obligation to contribute to the<br />

costs of the child’s care and upbringing and the costs of the child’s upkeep and education<br />

as a young adult (18-21). This obligation continues after the age of 21 if the child is<br />

indigent. The same obligation (article 1:394 Civil Co<strong>de</strong>) applies to a woman’s life partner<br />

who has consented to an act that may have resulted in the conception of the child<br />

(artificial insemination using donor sperm, in vitro fertilisation).<br />

NEW ZEALAND<br />

For child support it is the qualifying children from the re<strong>la</strong>tionship and for spousal maintenance<br />

it is the spouses (husband/wife).<br />

NORWAY<br />

Children up to 18 years of age will always be entitled to support. If the child has reached the age<br />

of 18 and study in a comprehensive, secondary education he/she will also be entitled to support,<br />

(discretionary assessment). In addition, spouses may receive maintenance support, but only if<br />

the divorced spouse is expected to have severe problems of supporting himself, caused by long<br />

periods of care for home and children.<br />

PANAMA<br />

In Panama are eligible to benefit from a <strong>de</strong>cision of maintenance, spouses between<br />

themselves, ascen<strong>de</strong>nt and <strong>de</strong>scen<strong>de</strong>nt re<strong>la</strong>tives, provi<strong>de</strong>d that it is proven in a judicial process<br />

the necessity of the benefit.<br />

PHILIPPINES<br />

Only the spouse and children (both legitimate and illegitimate) are entitled for support.<br />

POLAND<br />

The list of persons who are eligible to benefit from a maintenance <strong>de</strong>cision inclu<strong>de</strong>s children,<br />

spouse, kins, other direct re<strong>la</strong>tives. In exceptional situations also spouse’s children can be<br />

inclu<strong>de</strong>d.<br />

ROUMANIE<br />

Conformément à l’article 86 du Co<strong>de</strong> <strong>de</strong> <strong>la</strong> Famille, obligation d’entretien existe en le mari et <strong>la</strong><br />

femme, parents et enfants, celui qui adopte et l’adopté, grand-parents et neveux, arrières –<br />

grands parents et arrières neveux, frères et sœurs, mais aussi entre les autres personnes<br />

prévues par <strong>la</strong> loi.<br />
