RULING ON DEBT
REVIEW
In a bit of an unusual move the
National Consumer Tribunal
sent out a ruling about a debt
review matter to all Debt
Counsellors across the country
via blast email this month.
Other organisations and
associations were also asked
to spread the word. The ruling
had to do with consumers
who had been in debt review
once before and, among other
things, what accounts could be
included in debt review or not.
The Debt Counsellors involved
are one of the largest in the
country and because the ruling
went against them it appeared
to be rather negative for them.
The firm has now decided to
take the matter back to the
NCT for another hearing since
they did not actually know
about the case the first time it
was held. They never even got
to attend. Because they did not
present information to the NCT
about his case the ruling was
made without all the relevant
information. This is important
since this will then significantly
alter the ruling after the matter
is heard again this time with all
parties present. It seems that
the very unusual decision to
so quickly and publicly share
the ruling may have been
somewhat premature after all.
