Don’t Be Fooled<br />

For the six plus years, Publisher Dan and<br />

I have been conducting guardianship<br />

seminars across the Las <strong>Vegas</strong> Valley. During<br />

the course of the meetings, we are often approached by seniors with<br />

questions and their related experiences in dealing with the courts,<br />

lawyers etc.<br />

The name of one attorney comes up repeatedly in those complaints<br />

and questions. His name: David Bindrup.<br />

This attorney recently held one of his seminars; “Trust and<br />

Guardianship Laws” in my Sun City community. I received the<br />

following e-mail that very evening. With permission from its author<br />

I’d like to share it so that we can correct the misleading statements that<br />

were made.<br />

“In the course of his presentation, the man appeared to<br />

completely diss the idea of filing a Request to Nominate Guardian<br />

Form with the Nevada Lockbox.<br />

He went on to indicate that it could cost $2,000 to engage an<br />

attorney and have a District Court judge request the form from<br />

the lockbox, if it were needed. This appeared to me to be a “Fear<br />

Factor” to cause people to become his clients.<br />

He further appeared to favor having the Request to Nominate<br />

provision included in the Will/trust instead and indicated<br />

he would update Wills free of charge (as part of his Pro Bono<br />

work). He also indicated that something like 70% of the Request<br />

to Nominate<br />

Governor Sisolak signs “Support<br />

Decision Making” into law.<br />

Secretary of State Lockbox, that office will send you a personal i.d. card.<br />

On that card is a number which will enable you to change/update your<br />

form at any time.<br />

Guardianship cases are heard in Family Court, not District Court.<br />

And as of the 2017 legislative session, the court clerk will check the<br />

lockbox when a court request for guardianship is filed. If you have<br />

already nominated your preference and filed it with the State, the case<br />

is over.<br />

It is also absolutely correct that your guardian preference can be<br />

included in your trust documents and many are. But let me ask you<br />

one question: How does the hearing judge know what’s in the trust?<br />

The guardianship nomination form is FREE; filing it is FREE and for<br />

the court to get a copy requires a quick phone call from the clerk to the<br />

office and it is sent. No lawyer needed.<br />

*Assembly Bill 480 SUPPORTED DECISION MAKING (SDM):<br />

I have written about this several times, but today we celebrate that the<br />

bill was signed into law by Governor Sisolak.<br />

As of July 20<strong>19</strong> no longer will seniors have to fear being conscripted<br />

into a forced guardianship. What they need to do is chose a person<br />

they trust to be their SDM and for them to sign a SDM agreement. This<br />

person will help the senior with any major decisions in their lives.<br />

The best part is that the senior remains in his/her home, still in<br />

control of everything they hold dear.<br />
