ORDINARY COUNCIL MINUTES – 30 APRIL 2008 - 16 - Unresolved/outstanding issues identified at the stage of considering the Outline Development Plan and prior to this time when Council are about to consider subdivision relate to but may not be limited to; 1. Landscaping/Verge treatment 2. Barrier retaining walls need to be better identified with reference to construction material, height relativities to Monkey Mia Road and as separation between tourist/residential development. 3. Consideration of what type of tourist activity may be possible on the designated tourist sites to identify future access and egress points as part of a collective road interface overview that can be endorsed. The current subdivision application also requests the ability to stage the development in accordance with the plan submitted hereunder if, for economic or other practical reasons it may be unachievable within the proposed time schedule. ORDINARY COUNCIL MINUTES – 30 APRIL 2008 - 17 - While there remain a number of unresolved issues these can be further addressed at this stage and be made conditional upon the subdivision approval. The issue of staging the development is a reasonable request provided the finalisation of each stage is stand alone. Legal Implications The Shire of Shark Bay Town Planning Scheme No 3. The Western Australian Planning Commission. The Planning and Development Act 2005. Policy Implications Nil. Financial Implications The creation of new residential land stocks will have significant long term economic value for the growth of the Shire. Strategic Implications As this residential development is at the entrance to the Denham Town Site it is important that the entry statement being proposed by Council and the quality of this subdivision in terms of landscape and other aesthetic values and treatments compliment each other in design and finish. Recommendation That Engineering Consultant Montgomery Engineering on behalf of the proponent Sigma Syon Pty Ltd be advised that Council is prepared to approve the subdivision of Part North Location 59 Denham Road, Denham subject to the following conditions; a) Two sets of fully documented plans and specifications being submitted and approved prior to commencement. b) Payment of subdivision fee’s and work’s maintenance bonds. c) Staging of the subdivision will require each stage to be stand alone in service and amenity provision. d) The submission of landscaping/verge treatment plans and specifications for approval. e) Barrier retaining walls need to be better identified with reference to construction material, height relativities to Monkey Mia Road and as separation between tourist/residential development based on approved plans and specifications those works could be amended. f) Consideration of what type of tourist activity may be possible on the designated tourist sites to identify future access and egress points as part of a collective road interface overview that can be endorsed. g) Further negotiations need to be entered into in relation to resolve of public open space provision, compensation basins for storage water and entry statement considerations.
