ORDINARY COUNCIL MINUTES – 30 APRIL 2008 - 8 - On 28 February 2007 Council advised Dykstra Planning, on behalf of the proponent Sigma Syon Pty Ltd, that is was prepared to conditionally approve the proposed Outline Development Plan, Part North Location 59 Denham Road, Denham, for the purpose of referral and advertising subject to satisfactory agreement/approval and/or further information being obtained/provided and resolved to the satisfaction of Council during the course of the advertising period relative to the issues identified hereunder; 1. Footpaths and dual use paths not identified on the plan of possible options, for linkages to Shire‟s current infrastructure. 2. Landscaping/verge treatment not addressed in the plan. 3. Further information is required on the positioning and aesthetic treatment of stormwater compensation basins. 4. Proposed and future road interfaces for this development and potential future development in this location requires careful consideration and also endorsement from Main Roads WA. 5. Consideration also needs to be given to what type of Tourist activity may be possible on the designated tourist sites and for the need to now, through the Outline Development Plan process to identify future access and egress points as part of a collective road interface overview that can be endorsed.

Barrier retaining walls need to be better identified with reference to construction material, height relativities to Monkey Mia Road and as separation between tourist/residential developments. 7. Council need to agree to accept cash in lieu of public open space provision and identify where that income would be directed and on what it would be expended as is required when agreeing to accept same. 8. The Water Corporation in its submission to Town Planning Scheme No. 3 has identified the need for a 100 metre buffer between a residential development and its water treatment plant. This is an issue that will have to progress to satisfactory resolution through the advertising process. 9. That Council will allow the Outline Development Plan/Subdivision to progress concurrently with the progress of the finalisation of Town Planning Scheme No.3 and its intent for Special Use Zone 3 contained within Schedule 4 but with the proviso that a Scheme amendment may have to be initiated if there are unforseen delays to the finalisation of Town Planning Scheme No.3. On 30 May 2007 Council advised Dykstra Planning on behalf of the proponent Sigma Syon Pty Ltd that is was prepared to endorse the principles and objectives proposed in the Outline Development Plan for Part North Location 59 Denham Road, Denham, and will accordingly advise the Western Australian Planning Commission of its support. The Western Australian Planning Commission on 17 August 2007 granted conditional approval for the freehold (Green Title) subdivision of Part North Location 59 Denham Road once the following conditions set out had been fulfilled; CONDITIONS(S) 1.0 Those lots not fronting an existing road being provided with frontage to a constructed road(s) connected by a constructed road(s) to the local road system and such road(s) being constructed and drained at the applicant/owners cost. As an alternative, the Western Australian Planning Commission is prepared to accept the applicant/owner paying to the Local Government the cost of such road works as estimated by the Local Government subject to the Local Government given an assurance to the Commission that the works will be completed within a reasonable period acceptable to the Commission. (Local Government) 2.0 Street corners within the subdivision being truncated to the standard truncation of 8.5 metres. (Local Government) 3.0 Suitable arrangements being made with the Local Government for the provision of vehicular crossover(s) to service the lot(s) shown on the approved plan of subdivision (Local Government) 4.0 10% of the gross subdividable area as indicted on the approved Outline Development Plan, in a position to be agreed between the subdivider and the Local Government being shown on the Deposited Plan as a “Reserve for Recreation” and vested in the Crown under section 152 Planning and Development Act 2005, such land to be ceded free of cost and without any payment of compensation by the Crown. (Local Government) 5.0 The land being graded and stabilised to prevent sand blowing. (Local Government) 6.0 The land being filled and/or drained at the subdivider‟s cost to any satisfaction of the Western Australian Planning Commission and any easements and/or reserves necessary for the implementation thereof, being granted free of cost.
