The government needs clear air<br />

before Barton can re-introduce<br />

the issue and put it back in<br />

the limelight. The Premier has<br />

promised to give the issue proper<br />

consideration.<br />

TMP engaged consultants, along<br />

with Queen’s Counsel, lawyers<br />

and law firms, to ensure it was<br />

touching the right bases. Barton<br />

made a submission to the Premier<br />

directly and got a very fair hearing.<br />

Everything will go off to various<br />

departments to be analysed,<br />

then the government will make a<br />

decision.<br />

Barton and TMP definitely have<br />

not stopped working on this!<br />

Current legal actions<br />

Barton gave an update on the three<br />

legal actions in process.<br />

There is a lawsuit filed by a<br />

GoCatch against Uber. Barton has<br />

no input or involvement in this<br />

case, but informed us that this<br />

class action has been filed in the<br />

Supreme Court.<br />

There’s the Maurice Blackburn<br />

class action which has been<br />

going exactly as anticipated. The<br />

documents have been received –<br />

many thousands of them. Uber will<br />

fight tooth and nail but everyone<br />

in the opposition will do the same.<br />

Barton is confident in an overall<br />

win for us, as we’ve got the money,<br />

litigation funding and the best<br />

litigation company in the country<br />

doing it.<br />

Then there’s the closed class action<br />

filed by Victorian Taxi and Hire<br />

Car Families (VTHF) against the<br />

CPVV. As expected, the regulator<br />

is doing everything in its power<br />

to retreat. Last year there was a<br />

judgement made by the court that<br />

requested by VTHF from the<br />

CPVV should be released to the<br />

VTHF lawyers, and that 80% of<br />

what VTHF had spent should be<br />

reimbursed. Not all the documents<br />

have been received and not one<br />

cent has been given to VTHF.<br />

CPVV is not behaving appropriately<br />

– if it has nothing to hide then why<br />

doesn’t it release its documents!<br />
