The government needs clear air
before Barton can re-introduce
the issue and put it back in
the limelight. The Premier has
promised to give the issue proper
consideration.
TMP engaged consultants, along
with Queen’s Counsel, lawyers
and law firms, to ensure it was
touching the right bases. Barton
made a submission to the Premier
directly and got a very fair hearing.
Everything will go off to various
departments to be analysed,
then the government will make a
decision.
Barton and TMP definitely have
not stopped working on this!
Current legal actions
Barton gave an update on the three
legal actions in process.
There is a lawsuit filed by a
GoCatch against Uber. Barton has
no input or involvement in this
case, but informed us that this
class action has been filed in the
Supreme Court.
There’s the Maurice Blackburn
class action which has been
going exactly as anticipated. The
documents have been received –
many thousands of them. Uber will
fight tooth and nail but everyone
in the opposition will do the same.
Barton is confident in an overall
win for us, as we’ve got the money,
litigation funding and the best
litigation company in the country
doing it.
Then there’s the closed class action
filed by Victorian Taxi and Hire
Car Families (VTHF) against the
CPVV. As expected, the regulator
is doing everything in its power
to retreat. Last year there was a
judgement made by the court that

requested by VTHF from the
CPVV should be released to the
VTHF lawyers, and that 80% of
what VTHF had spent should be
reimbursed. Not all the documents
have been received and not one
cent has been given to VTHF.
CPVV is not behaving appropriately
– if it has nothing to hide then why
doesn’t it release its documents!
