5 How should <strong>IPART</strong> respond when a bus<strong>in</strong>ess fails the<br />

f<strong>in</strong>anceability test?<br />

5.2 In what circumstances should <strong>IPART</strong> make adjustments to address<br />

f<strong>in</strong>anceability issues?<br />

As <strong>in</strong>dicated above, our prelim<strong>in</strong>ary view is that, <strong>in</strong> pr<strong>in</strong>ciple, a regulated bus<strong>in</strong>ess<br />

<strong>and</strong> its owner should be primarily responsible for manag<strong>in</strong>g fluctuations <strong>in</strong> the<br />

bus<strong>in</strong>ess’s f<strong>in</strong>anceability. However, there are precedents for regulators <strong>in</strong>terven<strong>in</strong>g<br />

by adjust<strong>in</strong>g build<strong>in</strong>g block cost <strong>in</strong>puts (<strong>and</strong> thus <strong>price</strong>s) to address f<strong>in</strong>anceability<br />

concerns (see section 5.4 below).<br />

We would not wish to rule out such regulatory <strong>in</strong>tervention to ensure f<strong>in</strong>anceability.<br />

However, we consider it important to clearly identify the circumstances <strong>in</strong> which<br />

such <strong>in</strong>tervention might be appropriate. For example, these might <strong>in</strong>clude where the<br />

f<strong>in</strong>anceability concerns are likely to be severe or long-last<strong>in</strong>g.<br />

In mak<strong>in</strong>g our pric<strong>in</strong>g decisions, we are generally required to consider a number of<br />

factors <strong>in</strong>clud<strong>in</strong>g efficient <strong>price</strong>s, <strong>and</strong> the impacts of our pric<strong>in</strong>g decisions on<br />

consumers, the environment, competition <strong>and</strong> the f<strong>in</strong>ancial viability of a bus<strong>in</strong>ess.<br />

This makes it difficult for us to consider f<strong>in</strong>anceability issues <strong>in</strong> isolation <strong>and</strong><br />

particularly important to identify the circumstances when f<strong>in</strong>ancial viability concerns<br />

might outweigh other concerns.<br />

<strong>IPART</strong> seeks comment<br />

9 In what circumstances might it be appropriate for <strong>IPART</strong> to make adjustments to the<br />

build<strong>in</strong>g block model to address f<strong>in</strong>anceability concerns?<br />

5.3 What options for mak<strong>in</strong>g such adjustments are available?<br />

Potentially, <strong>IPART</strong> could address f<strong>in</strong>anceability issues by mak<strong>in</strong>g adjustments the<br />

<strong>in</strong>puts to the build<strong>in</strong>g block model, <strong>and</strong> thus to its proposed <strong>price</strong>s. The most<br />

obvious options for such adjustments are:<br />

� Adjust<strong>in</strong>g the WACC. Even a small <strong>in</strong>crease <strong>in</strong> the WACC could lead to a<br />

substantial improvement <strong>in</strong> the projected credit rat<strong>in</strong>gs. However, this option<br />

would lead to a gap between the regulatory <strong>and</strong> the f<strong>in</strong>ancial market cost of<br />

capital. Therefore, it would be a direct cost pass through to customers. In past<br />

decisions, we have made it clear that we do not consider it appropriate to adjust<br />

WACC parameters to address f<strong>in</strong>anceability issues.<br />

� Accelerat<strong>in</strong>g depreciation to br<strong>in</strong>g cash flows that would occur <strong>in</strong> the future<br />

forward <strong>in</strong>to the current determ<strong>in</strong>ation period. This would address immediate<br />

f<strong>in</strong>anceability concerns <strong>in</strong> a neutral manner, assum<strong>in</strong>g that it would not result <strong>in</strong><br />

f<strong>in</strong>anceability issues <strong>in</strong> the future.<br />
