Equality Act 1998 the Labour Court, <strong>on</strong> making a similar judgement, may refer a<br />

case to the Director for mediati<strong>on</strong> by an equality mediati<strong>on</strong> officer if the Court<br />

decides not to attempt to resolve the case itself. 78 The mediati<strong>on</strong> opti<strong>on</strong> is<br />

available to the parties at any stage in the investigati<strong>on</strong> process right up to the<br />

day of the hearing. It has often happened that a hearing is adjourned to give the<br />

parties an opportunity to resolve the case by mediati<strong>on</strong>. 79<br />

4.46 Mediati<strong>on</strong> at the Equality Tribunal is completely voluntary. In<br />

adhering to the c<strong>on</strong>sensual nature of mediati<strong>on</strong>, the 1998 and 2000 Acts<br />

provide that mediati<strong>on</strong> cannot take place if either party objects. 80 Mediati<strong>on</strong> has<br />

been reported to be more efficient than an investigati<strong>on</strong> before an equality<br />

officer, <strong>on</strong> average 3 times quicker. 81 An investigati<strong>on</strong> is a quasi-judicial process<br />

carried out by a Tribunal Equality Officer who will c<strong>on</strong>sider submissi<strong>on</strong>s from<br />

both parties before arranging a joint hearing or hearings of the case to enable<br />

him/her to reach a decisi<strong>on</strong> in the matter. Investigati<strong>on</strong>s are c<strong>on</strong>ducted by<br />

trained Equality Officers who have extensive powers to enter premises and to<br />

obtain informati<strong>on</strong> to enable them to c<strong>on</strong>duct an investigati<strong>on</strong>. Decisi<strong>on</strong>s are<br />

binding and are published.<br />

4.47 The mediati<strong>on</strong> process is informal and does not involve written<br />

submissi<strong>on</strong>s. Mediati<strong>on</strong> is c<strong>on</strong>ducted in private 82 and agreements are not<br />

published, unlike Equality Officer investigati<strong>on</strong>s and decisi<strong>on</strong>s. The parties are<br />

also given a ―cooling off‖ period before being asked to sign an agreement to<br />
