12.39 The Commissi<strong>on</strong> provisi<strong>on</strong>ally recommends that the courts should<br />

c<strong>on</strong>tinue to be pro-active in advising parties in property disputes to c<strong>on</strong>sider the<br />

adjournment of hearings to allow the parties to c<strong>on</strong>sider mediati<strong>on</strong> or<br />

c<strong>on</strong>ciliati<strong>on</strong>. [Paragraph 9.26]<br />

12.40 The Commissi<strong>on</strong> invites submissi<strong>on</strong>s <strong>on</strong> whether ADR, in particular<br />

mediati<strong>on</strong>, has a role to play in the resoluti<strong>on</strong> of planning applicati<strong>on</strong> disputes.<br />

12.41 The Commissi<strong>on</strong> provisi<strong>on</strong>ally recommends that training and<br />

accreditati<strong>on</strong> of mediators is essential to ensure the quality of the process and<br />

invites submissi<strong>on</strong> as to whether this should be included in any statutory<br />

framework for mediati<strong>on</strong>. [Paragraph 10.09]<br />

12.42 The Commissi<strong>on</strong> provisi<strong>on</strong>ally recommends that the relevance of<br />

ADR, including mediati<strong>on</strong> and c<strong>on</strong>ciliati<strong>on</strong>, should be incorporated into third<br />

level programmes in law and other disciplines and the professi<strong>on</strong>al programmes<br />

c<strong>on</strong>ducted by the <strong>Law</strong> Society of Ireland and the Bar Council of Ireland.<br />

12.43 The Commissi<strong>on</strong> invites submissi<strong>on</strong>s as to whether the regulati<strong>on</strong> of<br />

mediators should c<strong>on</strong>tinue at present <strong>on</strong> a n<strong>on</strong>-statutory basis, subject to the<br />

principles to be set out in a statutory framework for mediati<strong>on</strong> and c<strong>on</strong>ciliati<strong>on</strong>.<br />

12.44 The Commissi<strong>on</strong> provisi<strong>on</strong>ally recommends that all family mediators<br />

should receive specialist training in this particular area. [Paragraph 10.65]<br />

12.45 The Commissi<strong>on</strong> provisi<strong>on</strong>ally recommends that a n<strong>on</strong>-statutory<br />

scheme should be established, under the auspices of the Department of<br />

Justice, Equality and <strong>Law</strong> <strong>Reform</strong>, to provide for the accreditati<strong>on</strong> of<br />

organisati<strong>on</strong>s, which, in turn, accredit individual ADR practiti<strong>on</strong>ers. [Paragraph<br />

10.66]<br />

12.46 The Commissi<strong>on</strong> provisi<strong>on</strong>ally recommendati<strong>on</strong>s a Court should not<br />

impose a good faith requirement in mediati<strong>on</strong> or c<strong>on</strong>ciliati<strong>on</strong> as this would risk<br />

undermining key principles, including the right to self-determinati<strong>on</strong>, the<br />

voluntary nature of the process, the neutrality of the mediator or c<strong>on</strong>ciliator and<br />

the c<strong>on</strong>fidentiality of the process. The Court should, however, encourage parties<br />

to mediate in good faith. [Paragraph 11.36]<br />

12.47 The Commissi<strong>on</strong> invites submissi<strong>on</strong>s as to whether, in general, costs<br />

sancti<strong>on</strong>s should be imposed <strong>on</strong> a party by a Court for an unreas<strong>on</strong>able refusal<br />

to c<strong>on</strong>sider mediati<strong>on</strong> or c<strong>on</strong>ciliati<strong>on</strong> and whether a Court should apply the<br />

following factors in determining that a party has unreas<strong>on</strong>ably refused to<br />
